Pembangunan infrastruktur di Indonesia membutuhkan instrumen penjaminan yang memberikan kepastian hukum terhadap risiko wanprestasi kontraktor. Surety bond unconditional secara normatif memungkinkan pencairan klaim tanpa pembuktian terlebih dahulu, namun dalam praktik masih sering terjadi penundaan atau penolakan pembayaran klaim oleh penjamin yang memicu sengketa hukum. Penelitian ini menggunakan metode penelitian hukum normatif dengan tipe penelitian deskriptif. Pendekatan yang digunakan meliputi pendekatan perundangundangan, konseptual, dan pendekatan kasus. Data diperoleh melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier, yang dianalisis secara kualitatif untuk menilai penerapan norma hukum dan pertimbangan yuridis dalam praktik pembayaran klaim surety bond. Hasil penelitian menunjukkan bahwa penjamin dalam surety bond unconditional memiliki kewajiban hukum untuk membayar klaim kepada obligee setelah terpenuhinya persyaratan formal klaim, tanpa bergantung pada pembuktian wanprestasi principal melalui proses peradilan. Sengketa pembayaran klaim dapat diselesaikan melalui mekanisme non-litigasi maupun litigasi, dengan konsekuensi hukum berupa wanprestasi penjamin apabila terjadi penolakan pembayaran tanpa dasar hukum yang sah. Penelitian ini diharapkan dapat menjadi pedoman bagi perusahaan penjamin dalam menyusun klausul surety bond yang jelas dan melindungi hak obligee, sekaligus memperkuat kepastian hukum dalam pelaksanaan proyek konstruksi di Indonesia. Infrastructure development in Indonesia requires guarantee instruments that provide legal certainty against the risk of contractor default. One of the instruments widely used is the unconditional surety bond, which normatively allows the disbursement of claims without prior proof of default by the principal. However, in practice, delays or refusals in claim payment by guarantors still frequently occur, giving rise to legal disputes. This research employs a normative legal research method with a descriptive type of study. The approaches used include the statutory approach, conceptual approach, and case approach. The data were obtained through a literature study of primary, secondary, and tertiary legal materials, which were qualitatively analyzed to assess the application of legal norms and juridical considerations in the practice of surety bond claim payments. The results indicate that guarantors in unconditional surety bonds have a legal obligation to pay claims to the obligee once the formal claim requirements are fulfilled, without depending on judicial proof of the principal’s default. Disputes concerning claim payments may be resolved through non-litigation or litigation mechanisms, with legal consequences in the form of guarantor default if payment is refused without legitimate legal grounds. This research is expected to serve as a guideline for guarantor companies in drafting clear surety bond clauses that protect the rights of obligees, while also strengthening legal certainty in the implementation of construction projects in Indonesia.
