Penelitian ini bertujuan untuk menganalisis kewenangan MPR dalam mengubah TAP MPR sebelum dan setelah perubahan Undang-Undang Dasar (UUD) Tahun 1945. Permasalahan yang dikaji meliputi bagaimana kewenangan MPR dalam mengubah TAP MPR pada masa sebelum maupun setelah perubahan UUD Tahun 1945 dan bagaimana kewenangan MPR dalam mengubah TAP MPR tersebut dari perspektif teori kewenangan negara hukum dan teori hierarki norma. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier, yang diperoleh melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa sebelum perubahan UUD Tahun 1945, MPR memiliki kewenangan yang sangat luas sebagai lembaga tertinggi negara, termasuk dalam membentuk dan mengubah, TAP MPR yang kewenangan tersebut bersifat atribusi langsung dari konstitusi. Namun, setelah perubahan UUD Tahun 1945, MPR tidak lagi menjadi lembaga tertinggi negara sehingga kewenangan MPR mengalami pembatasan dan tidak lagi secara eksplisit mencakup kewenangan untuk mengubah TAP MPR. Hal ini menimbulkan kekosongan norma dan ketidakpastian hukum khususnya terkait mekanisme perubahan atau pencabutan TAP MPR yang masih berlaku. Kondisi tersebut bertentangan dengan prinsip kewenangan negara hukum dan hierarki norma yang mengharuskan setiap tindakan lembaga negara didasarkan pada kewenangan dan aturan yang sah. This study aims to analyze the authority of the People's Consultative Assembly (MPR) in amending MPR Decrees (TAP MPR) before and after the amendment of the 1945 Constitution (UUD Tahun 1945). The issues examined include the nature of the MPR's authority to amend TAP MPR during the periods prior to and following the amendment of the UUD Tahun 1945, as well as how this authority is viewed from the perspectives of the theory of authority in a legal state and the theory of the hierarchy of norms. This research is a normative legal study employing a statutory approach, a conceptual approach, and a case approach. The data utilized are secondary data consisting of primary, secondary, and tertiary legal materials obtained through literature study. The results indicate that prior to the amendment of the UUD Tahun 1945, the MPR held extensive authority as the highest state institution, which included formulating and amending TAP MPR an authority directly at tributed by the constitution. However, following the amendment of the UUD Tahun 1945, the MPR was no longer designated as the highest state institution; consequently, its powers were restricted and no longer explicitly encompass the authority to amend TAP MPR. This situation creates a normative vacuum and legal uncertainty, particularly concerning the mechanism for amending or revoking TAP MPR that remain in force. This condition contradicts the principle of authority in a legal state and the hierarchy of norms, both of which require every action of a state institution to be grounded in valid authority and legal rules.
