Abstrak Tanah kas kampung merupakan salah satu pendapatan kampung yang menjadi sumber keuangan kampung, tanah kas kampung wajib disertifikatkan atas nama pemerintah kampung yang bersangkuatan, karena sertifikat merupakan alat bukti hak yang kuat sebagaimana tercantum dalam Pasal 32 (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Namun di Kampung Sidomulyo tanah-tanah kas kampung telah bersertifikat hak milik atas nama pribadi, di dalam Peraturan Daerah Kabupaten Tulang Bawang Nomor 12 Tahun 2001 tanah-tanah kas kampung yang telah dimiliki dan dikelola oleh kampung tidak dapat dipindah tangankan kepihak lain tanpa adanya pelepasan tanah kas kampung dengan hasil persetujuan masyarakat kampung yang telah mendapat persetujuan dari lembaga kampung dan pemerintah kampung yang baru akan dimintakan kepada Bupati, kepala daerah yang berwenang untuk memberikan. Permasalahan yang diteliti adalah (1) Bagaimanakah pelaksanaan Peningkatan Status Tanah Bekas Kas Kampung Menjadi Tanah Hak Milik Di Kampung Sidomulyo Kecamatan Penawar Tama Kabupaten Tulang Bawang dan (2) Apakah akibat hukum dari Peningkatan Status Tanah Bekas Kas Kampung Menjadi Tanah Hak Milik Di Kampung Sidomulyo Kecamatan Penawar Tama Kabupaten Tulang Bawang tersebut. Penelitian ini bertujuan untuk mengetahui pelaksanaan peningkatan status tanah Bekas Kas Kampung Menjadi Tanah Hak Milik serta untuk mengetahui akibat hukum terhadap peningkatan status tanah Bekas Kas Kampung Menjadi Tanah Hak Milik di Kampung Sidomulyo Kecamatan Penawar Tama Kabupaten Tulang Bawang. Penelitian ini menggunakan metode penelitian berupa pendekatan hukum normatif dan hukum empiris. Data primer diperoleh dari pegawai Kantor Pertanahan Kabupaten Tulang Bawang dan Kepala Kampung Sidomulyo Kecamatan Penawar Tama Kabupaten Tulang Bawang serta pihak-pihak yang mengetahui duduk DARMANTO perkara peningkatan status tanah bekas kas kampung tersebut, sedangkan data sekunder berupa buku-buku atau literatur-literatur dan peraturan perundangundangan mengenai pertanahan, hasil penelitian terdahulu, artikel, berkas-berkas atau dokumen-dokumen. Teknik pengumpulan data yang digunakan adalah studi dokumen dan studi lapangan. Teknik analisis data menggunakan analisis data kualitatif. Hasil penelitian dan pembahasan menunjukkan bahwa tanah kas kampung Sidomulyo pada tanggal 20 September 2000 telah dirubah statusnya dengan ditingkatkannya menjadi hak milik perorangan melalui program ajudikasi tanah yang diselenggarakan oleh Kantor Pertanahan Kabupaten Tulang Bawang. Dengan diterbitnya sertifikat hak milik nomor 2312 atas nama Harianto dengan dasar pendaftaran Surat Keputusan Kepala Kantor Pertanahan Kabupaten Tulang Bawang Nomor 11/HM/AJU/SWD/08.06/2000, maka tanah kas kampung Sidomulyo secara hak telah hapus dan merubah satatus kepemilikannya menjadi hak milik dan sudah sah secara formal. Hal ini karena sertifikat hak tanah merupakan bentuk Keputusan Tata Usaha Negara yang dapat menimbulkan akibat hukum berarti menimbulkan perubahan dalam hubungan hukum yang ada. Saran atas ditingkatkannya status tanah bekas kas kampung menjadi hak milik antara lain : (1) Hendaknya ada himbauan agar masyarakat dan pejabat yang menjalankan pemerintahan harus secara bersama-sama sadar akan tertib hukum demi terciptanaya kesadaran dan tertib administrasi pemerintahan. (2) Untuk kepentingan masyarakat kampung dan kekayaan pemerintah kampung, hendaknya tanah-tanah kas kampung yang belum bersertifikat atas nama pemerintah kampung agar secepatnya dilakukan pendataan dan segera diurus surat-suratnya dan atau segera disertipikatkan atas nama pemerintah kampung setempat agar tidak terjadi kasus-kasus tentang lepas atau tertukarnya tanah-tanah kas kampung tersebut. (3) Dengan terjadinya peristiwa Peningkatan status tanah kas kampung menjadi hak milik ini dapat dijadikan pelajaran dan evaluasi dari semua pihak agar ke depan dapat tercipta suatu pemerintahan desa yang dapat mengayomi masyarakat dan menjaga hak miliknya sesuai wewenang yang dimiliki berdasarkan pada peraturan yang berlaku dan yang menjadi tanggung jawabnya. Abstract The land status of cash village is one of the village income which a village finance sources, the land status of cash village must be sertifikated by the village institution, because sertificate is a rightfil evidence absolutely. As included in Pasal 32 (1) Peraturan Pemerintah No. 24 Tahun 1997 abaut the regestration of the land. But in the Sidomulyo village, the land of cast village had sertifikated to be the personal righful property, in the role of Tulang Bawang Regency No. 12 Tahun 2001 cash village lands that have been owned and managed by the village can not be transferred to another party without the release of land with the consent of cash village, village communities that have received approval from the village and the government agencies that the new villages will be requested to the Regent, head of the local authority to provide. The research problem are (1) How is the carrying of the increase of the used land status of cash village to be the rightful property in Sidomulyo village, Penawar Tama sub district, Tulang Bawang Regency. And (2) What is the law result from the increase of the used land status of cash village to be the righful property land in Sidomulyo Village, Penawar Tama Sub District, Tulang Bawang Regency. The goals of this research are how to know the law result of the increase of the used land status of cash village in Sidomulyo Village, Penawar Tama Sub District, Tulang Bawang Regency. The methodology of research used normative law approach and empirical law approach. The primary data is gotten from the employees of land affairs office of Tulang Bawang regency, a village chief of Sidomulyo Village, Penawar Tama Sub District, Tulang Bawang Regency and some people who know the problem of the land status of cash village, white the secondary data is gotten from books or literatures and and the rules of ordinance abaut the land, the resuld research, article, documents. The data collecting technique of the research are the document study and practice study. The data analysis used qualitative data. DARMANTO The result of the research and discussion showed that the land of cash village in Sidomulyo on September 20 Tahun 2000 had changed the status. It looked by the incresing the land of cash village to be the rightful properties by the land ajudication program that showed by the land affairs office in Tulang Bawang agency. It faced by appearing the sertificated of rigtful property No. 2312 with name Harianto, as abased on the registrarion of decision latter from the leader of land affairs office, Tulang Bawang Regency No. 11/HM/AJU/SWD/08.06/2000, so the land of cash village in Sidomulyo Village could change its rigtful and it have been legal, because sertificated is a country rule decision that can appear the cause of the law. The suggestions are (1) giving advice to people and official must aware to the rule of the law in Indonesia. So, it can create awareness and help the goverment in the goverment administration, especialy land problem. (2) the goverment can give the facilities for people to manage the land of cash village to be the rightfu l properties and can be sertificated. So, it will not cause the problem next time. (3) the increasing of the used land of cash village can’t be the personality rightful properties. So, the problem which happened last day can be expericed to be created comfortability in the village institutioan. And the village institution can protect and keep the rightful properties of village as its authority and its obligation. Key Word : Raising, The land of village, Proprietary rights.
