Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Undang Undang No.13 Tahun 2003 tentang Ketenagakerjaan tidak menjangkau para PRT ke dalam sistem perundangan umum mengenai perlindungan hukum terhadap PRT. Karena PRT dianggap tidak dipekerjakan oleh “pengusaha”, mereka tidak diberikan perlindungan yang diberikan oleh undang-undang terhadap pekerja lainnya. Dalam undang-undang ketenaga kerjaan pekerja rumah tangga belum diatur secara detail tentang dasar terminology pekerja rumah tangga. Akan tetapi konvensi ILO menegaskan bahwa pekerja rumah tangga yang sebelumnya dikenal dengan pembantu rumah tangga sudah diakui dan dianggap sebagai tenaga kerja. Perumusan masalah dalam penelitian ini adalah: Bagaimana pola hubungan hukum pembantu rumah tangga dengan majikan ? Bagaimanakah perlindungan hukum terhadap PRT di Kota Bandar Lampung. Penelitian ini merupakan penelitian normatif empiris. Langkah-langkah yang dilakukan peneliti untuk melakukan penelitian adalah dengan cara mencari informan di Dinas Tenaga Kerja Kota Bandar Lampung, untuk mendapatkan data subjek penelitian yang benar-benar sesuai dengan karakteristik subjek penelitian, yaitu Majikan dan Pembantu rumah tangga. Proses pengambilan data dilakukan dengan wawancara. Analisis data dilakukan dengan cara deskriptif kualitatif dengan mendeskripsikan atau menggambarkan data yang dihasilkan dari penelitian lapangan kedalam bentuk penjelasan dengan cara sistematis. Hasil yang diperoleh Penulis dari penelitian ini bahwa : (1) Pola hubungan antara PRT dengan majikan banyak dikondisikan dalam relasi kekeluargaan, yang dalam banyak hal dapat mengaburkan adanya relasi hubungan kerja antara PRT dengan majikan. (2) perlindungan hukum terhadap PRT saat ini belum berjalan di Kota Bandar Lampung karena: (a) Undang Undang No 13 Tahun 2013 tentang Ketenagakerjaan belum sepenuhnya mengatur tentang PRT. (b) Belum ada peraturan khusus yang mengatur tentang PRT. (c) Pengawasan yang dilakukan oleh Dinas Tenaga Kerja Kota Bandar Lampung belum optimal. (d) Agen penyalur PRT di Kota Bandar Lampung belum terdaftar di Dinas Tenaga Kerja Kota Bandar Lampung. (e) Belum adanya tempat layanan pengaduan untuk PRT. (f) Kurangnya pengetahunan yang dimiliki oleh PRT. Kata Kunci : Perlindungan Hukum, PRT, Kota Bandar Lampung LEGAL PROTECTION AGAINST HOUSEHOLD HELPER IN BANDAR LAMPUNG CITY BY FRAN RADY Law 13 of 2003 on Labour not to include domestic workers in the system of general legislation regarding legal protection for domestic workers. Because domestic workers are considered to be employed by "employers", they are not given the protection provided by the law against other workers. In the legislation employment of domestic workers has not been regulated in detail about the basic terminology of domestic workers. But the ILO insists that domestic workers formerly known as housekeeper already recognized and regarded as labor. Formulation of the problem in this research is: What is the pattern of legal relations housemaid with employers? How is legal protection of domestic workers in the city of Bandar Lampung. This research is empirical normative. Measures conducted by researchers to conduct research is to seek informants in the Department of Labor in Bandar Lampung, to obtain the data subject of study that really suit the characteristics of the study subjects, namely the employer and the housemaid. The process of data collection is done with the interview. Data was analyzed using descriptive way to describe or depict qualitative data generated from field research in the form of an explanation in a systematic way. Results obtained Authors of this study that: (1) The pattern of the relationship between domestic workers and employers much conditioned in familial relationships, which in many cases could obscure the relationship employment relationship between domestic workers and employers. (2) the legal protection of domestic workers is not currently running in the city of Bandar Lampung because: (a) Law No. 13 Year 2013 on Employment has not completely set on domestic workers. (B) There are no special rules governing the PRT. (C) Monitoring conducted by the Department of Labor in Bandar Lampung has not been optimal. (D) Agent PRT dealer in Bandar Lampung has not been registered in the Department of Labor in Bandar Lampung. (E) The absence of a complaint for domestic services.
