Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Peraturan Daerah Nomor 16 Tahun 2011 tentang Kedudukan Keuangan Kepala Desa dan Perangkat Desa mengatur pengasilan kepala desa dan perangkat desa yang terdiri dari penghasilan tetap, tunjangan sah dan tunjangan lainnya. Dengan diterapkannya sistem penghasilan dari Pemerintah Kabupaten Pesawaran, kepala desa dan perangkat desa tidak lagi diizinkan untuk mengelola tanah kas desa Permasalahan dalam penelitian ini adalah bagaimanakah penerapan sitem penghasilan Kepala Desa dan Perangkat Desa di Desa Gedong Dalam Kabupaten Pesawaran dan hambatan dalam penerapan sistem penghasilan Kepala Desa Dan Perangkat Desa. Pendekatan masalah yang digunakan adalah pendekatan yuridis normatif dan yuridis empiris. Data yang digunakan adalah data primer dan sekunder. Data yang sudah diolah kemudian disajikan dalam bentuk uraian, lalu dintreprestasikan atau ditafsirkan untuk dilakukan pembahasan dan dianalisis secara kualitatif, kemudian untuk selanjutkan ditarik suatu kesimpulan. Berdasarkan hasil penelitian dan pembahasan diketahui bahwa penerapan sistem penghasilan Kepala Desa dan Perangkat Desa di Desa Gedong Dalam Kabupaten Pesawaran sudah dilaksanakan dengan baik. Hal ini terbukti bahwa ketentuanketentuan yang mengharuskan tanah desa sebagai bentuk gaji kepala desa dan perangkat desa di kembalikan ke desa untuk di jadikan tanah kas desa. Penyamarataan Penghasilan Tetap yang diterima oleh perangkat desa dan penyesuaian tunjangan dari status pernikahannya. Penerapan suatu peraturan selalu memberikan konsekuensi tersendiri terhadap pihak-pihak yang terlibat atau dikenai peraturan tersebut. Hambatan dalam penerapan sistem penghasilan Kepala Desa Dan Perangkat Desa di Desa Gedong Dalam Kabupaten Pesawaran berasal dari peraturan perundang-undangan dan pelaksananya. Hambatan tersebut aberasal dari Peraturan Daerah Nomor 16 Tahun 2011 dan perangkat desa selaku pelaksananya. Hambatan yang bersifat yuridis muncul karena ketidaksesuaian antara peraturan yang satu dengan yang lainnya atau peraturan tersebut saling bertentangan. Sedangkan hambatan teknis yaitu hambatan yang timbul pelaksana peraturan tersebut dilaksanakan di lapangan. Hambatan ini terjadi karena adanya ketidaksesuaian antara peraturan yang tertulis dengan keadaan sosiologis pada saat pelaksanaannya. Kata Kunci: Penerapan, Sistem Penghasilan, Perangkat Desa.
