Abstract

Perjalanan sejarah Indonesia adalah sebuah saksi bahwa Indonesia sedang berproses menuju sebuah negara yang konstitusional. Dalam konteks ini tujuan penulisan ini adalah untuk menunjukkan transformasi kedaulatan konstitusional di Indonesia dengan menggunakan pendekatan historis sistem ketatanegaraan Indonesia yang dikuatkan dengan putusan-putusan Mahkamah Konstitusi. Hasil penelitian ini menunjukkan bahwa periode sejak Indonesia merdeka sampai berakhirnya Orde Baru adalah sebuah rezim yang inkonstitusional. Tahun 1998 terjadi peristiwa besar yakni runtuhnya kedaulatan negara absolut dan utuh yang menjadi sebuah pertanda dimulainya sistem kedaulatan yang baru yakni kedaulatan konstitusional. Kedaulatan konstitusional diartikan bahwa konstitusi merupakan kekuasaan tertinggi di dalam sebuah negara. Kata Kunci: Transformasi, Kedaulatan, Konstitusional TRANSFORMATION OF CONSTITUTIONAL SOVEREIGNTY The history has witnessed the transformation of Indonesia towards a constitutional state. In this context, the purpose of this paper is to prove that the transformation of constitutional sovereignty in Indonesia is evident. Using a historical dynamic of constitutionalism reinforced by the analysis of Indonesia Constitutional Court judgment, this study indicate that the transformation toward constitutional sovereignty is evident. Reformation period after 1998 tragedy marked the collapse of absolute state sovereignty and the beginning of constitutional sovereignty in Indonesia. Constitutional sovereignty means that the constitution, normatively and substantively is the supreme authority in a country. Keywords: Transformation, Sovereignty, Constitutional
