Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Penulisan skripsi ini bertujuan untuk menguraikan tafsir konstitusional Mahkamah Konstitusi dalam Pengujian Undang-Undang yang berkaitan dengan perlindungan lingkungan hidup. Metode penelitian yang digunakan untuk menjawab pertanyaan tersebut adalah normativ yuridis dengan menggunakan analisa interpretasi dan konstruksi hukum sehingga menghasilkan argumentasi hukum melalui penalaran hukum yang logis dan sistematis. Hasil penelitian terhadap 17 putusan Mahkamah Konstitusi yang didalamnya menunjukkan bahwa Mahkamah Konstitusi memiliki penafsiran konstitusional terhadap upaya perlindungan lingkungan hidup. Berdasarkan penelitian terhadap putusan-putusan tersebut, dapat diketahui bahwa Mahkamah Konstitusi tidak hanya memiliki penafsiran yang berpihak terhadap upaya perlindungan lingkungan dan sumberdaya alam, tetapi juga penafsiran yang tidak berpihak terhadap perlindungan lingkungan, serta terdapat beberapa faktor yang menjadi penentu dalam putusan MK, diantaranya, faktor konservasi, faktor eksploitasi, dan faktor kesejahteraan masyarakat. Kata Kunci: Perlindungan Lingkungan, Tafsir Konstitusional MK, Putusan MK GREEN JUDGEMENT (Studies Constitutional Court Decision) This thesis aims to outline the constitutional interpretation of the Constitutional Court in the Judicial Review of Law relating to environmental protection. The method used to answer these questions is by using analysis of normativ juridical interpretation and legal construction so as to produce legal arguments through legal reasoning logical and systematic. The study, of 17 Constitutional Court ruling in which indicates that the Constitutional Court has the constitutional interpretation of the environmental protection efforts. Based on a study of these decisions, it is known that the Constitutional Court not only have the interpretation in favor of the efforts to protect the environment and natural resources, but also the interpretation that is not biased against environmental protection, and there are several factors that determines the decision of the Court, among other things, factors of conservation, exploitation factor, and factor public welfare.
