Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Peraturan desa merupakan salah satu jenis peraturan perundang-undangan yang dibuat oleh kepala desa bersama badan pemusyawaratan desa yang dijadikan dasar bagi penyelenggaraan pemerintahan desa. Peraturan desa dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan sebagai pengganti dari Undang-Undang Nomor 10 Tahun 2004 tentang Pembentukan Peraturan Perundang-Undangan, tidak lagi mengatur secara tegas kedudukan peraturan desa dalam hierarki peraturan perundang-undangan. Kedudukan dalam hierarki peraturan perundang-undangan dapat menentukan lembaga mana yang berwenang melakukan pengujian peraturan desa. Didasarkan pada permasalahan itu, maka melalui penelitian ini diharapkan dapat menjawab permasalahan berkaitan dengan pengujian peraturan desa dalam sistem peraturan perundang-undangan Indonesia melalui suatu penelitian dengan menggunakan metode yuridis normatif (dogmatic research) yaitu penelitian yang dilakukan dengan menginventaris dan mengkaji dokumen-dokumen hukum dan karya tulis lainnya. Hasil penelitian ini menunjukkan bahwa berdasarkan kewenangan yang dimiliki oleh bupati/walikota menurut Undang-Undang Nomor 6 tahun 2014 tentang Desa dan peraturan pelaksananya, peraturan desa dapat diuji melalui mekanisme pengawasan yang dimiliki bupati/walikota baik melalui pengawasan preventif yang dilakukan dengan cara evaluasi atau disebut sebagai “eksekutif preview”maupun melalui mekanisme pengawasan secara refresif yang dilakukan dalam proses klarifikasi atau disebut juga “eksekutif review”, selain itu dalam hal pengujian peraturan desa BPD dapat dijadikan saluran antara masyarakat dengan bupati/walikota dalam melakukan pengujian peraturan desa. TESTING SYSTEM REGULATION OF THE VILLAGE OF REGULATION LEGISLATION INDONESIA The regulation of the village is one of the types of legislation that is made by the head of the village along the BPD was made the basis for the Organization of the Government of the village. The village rules in the law number 12 of the year 2011 on the establishment of Regulations in lieu of law No. 10 of 2004 on the establishment of Regulations, no longer regulate expressly the position of village regulations in the hierarchy of legislation. The position in the hierarchy of legislation may determine the institution where the authorities conduct testing of the regulation of the village.Based on that problem, then through this study is expected to address issues related to testing of village regulations in the regulatory system regulation legislationIndonesia through a research using normative juridical (dogmatic research) the research done by an inventory and review legal documents and other papers. The results of this study indicate that by the authority possessed by the regent / mayor according to Law No. 6 of 2014 on the village and its implementing regulations, village rules can be tested through oversight mechanisms owned regent / mayor either through oversight preventive done by evaluation or referred to as "executive preview" or through the mechanism of supervision repressive performed in the process of clarifying or also known as "executive review", other than that in Paternity test BPD village regulations can be a channel between the community and district heads / mayors in testing village regulations.
