Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

ABSTRAK Perkembangan teknologi informasi seperti internet semakin hari dirasakan semakin meningkat. Dampak negatif yang ditimbulkan salah satunya dalam bidang Hak Kekayaan Intelektual yaitu lagu dengan mudah dapat diunduh. Lagu yang diinginkan oleh pengguna internet dapat diunduh secara gratis tanpa membayar royalti. Pencipta lagu tentu dirugikan atas tindakan tersebut. Permasalahan yang dibahas dalam penelitian ini adalah bagaimana perlindungan hukum hak cipta terhadap pencipta lagu yang diunduh melalui internet dan upaya apa yang dilakukan dalam melindungi hak cipta pencipta lagu yang diunduh melalui internet Jenis penelitian yang digunakan adalah normatif dengan tipe penelitian deskriptif. Pendekatan masalah yang digunakan dalam penelitian ini adalah normatif analitis. Data yang digunakan adalah data sekunder, dan pengumpulan data dilakukan dengan studi pustaka dan studi dokumen. Data yang terkumpul kemudian diolah melalui tahapan pemeriksaan data, rekonstruksi data dan sistematisasi data. Setelah diolah kemudian dianalisis secara kualitatif. Hasil penelitian menyatakan bahwa perlindungan hukum hak cipta terhadap pencipta lagu yang diunduh melalui internet dilakukan dengan cara yaitu secara administrasi, melalui instrumen hukum pidana dan gugatan perdata. Upaya hukum yang dilakukan dalam melindungi hak cipta pencipta lagu yang diunduh melalui internet dilakukan beberapa cara yaitu Kementerian Informasi dan Teknologi untuk berperan aktif dalam melakukan pemblokiran terhadap situs-situs yang menyediakan fasilitas download lagu gratis dan menyiapkan sumber daya manusia di bidang penyidikan seperti dari Kepolisian Negara Republik Indonesia serta Penyidik Pegawai Negeri Sipil dan lainnya seperti jaksa dan hakim yang memiliki kemampuan dan pengetahuan di bidang HKI serta peran Dewan Hak Cipta untuk memberikan pengetahuan mengenai arti penting HKI. Kata Kunci : Perlindungan Hukum, Hak Cipta, Lagu, Internet. ABSTRACT The development of information technology such as the Internet increasingly the perceived increasing. The negative impact of one of them in the field of Intellectual Property Rights which songs can easily be downloaded. The desired song by Internet users can be downloaded for free without paying royalties. Songwriter necessarily disadvantaged by such action. The problems discussed in this research is how the legal protection of copyright against the creators of the song that is downloaded via the internet and what is done in an effort to protect the copyright songwriter that is downloaded via the Internet. This type of research is normative and descriptive type. Approach to the problem used in this study is a normative analytical. The data used is secondary data, and data collection is done by literature and document research. The collected data is then processed through the stages of examination of the data, the data reconstruction and systematization of data. Once processed and analyzed qualitatively. The study states that the legal protection of copyright against the creators of songs downloaded through the internet done in a way that the administration, through the instrument of criminal law and civil lawsuit. Legal efforts to protect the copyright of the creator of the song that is downloaded via the internet to do some ways that is the Ministry of Information and Technology to actively participate in doing the blocking of websites that provide the facility to download songs for free, and prepare human resources in the field of investigation as the police of Republic of Indonesia and civil servant investigators and others such as prosecutors and judges who have the ability and knowledge in the field of IPR and the role of the Copyright Council to provide knowledge about the importance of IPR.
