Penulisan skripsi ini bertujuan untuk mengetahui upaya pemenuhan hak masyarakat adat atas tanah adat di kawasan hutan negara dan kendala-kendala yang dihadapi dalam upaya pemenuhan hak masyarakat adat atas tanah adat di kawasan hutan negara pada masyarakat adat Megou Pak Tulang Bawang Marga Suway Umpu (Masyarakat Talang Gunung) di Register 45 Sungai Buaya Kabupaten Mesuji. Metode Penelitian yang digunakan pendekatan normatif dan untuk melengkapi data dilakukan wawancara secara terbuka dengan Kepala Bidang Kehutanan pada Dinas Kehutanan Kabupaten Mesuji. Data yang digunakan dalam penelitian ini bersumber dari data primer, data skunder dan data tersier. Hasil penelitian ini menunjukan upaya pemenuhan hak konstitusional masyarakat adat Megou Pak Tulang Bawang Marga Suway Umpu (Masyarakat Talang Gunung) di Register 45 Sungai Buaya Mesuji telah dilakukan dengan pengajuan permohonan peninjauan kembali perluasan kawasan Register 45 Sungai Buaya oleh masyarakat adat kepada Pemerintah Kabupaten Mesuji dan Menteri Kehutanan hingga dikeluarkan enclave seluas 149,1 Ha dan 7000 Ha yang diklaim sebagai tanah adat oleh masyarakat dikurangi enclave akan dikelola dengan pola kemitraan namun hal tersebut mendapat penolakan dari masyarakat adat. Upaya pemenuhan hak tersebut mengalami beberapa kendala berupa kendala yuridis, geografis maupun sosiologis. Kata Kunci : Hak Konstitusional, Masyarakat Adat, Tanah Adat, Hutan Negara EFFORTS OF FULFILLING THE RIGHT OF CONSTITUTIONAL INDIGENOUS THE GROUND CUSTOMARY IN THE REGION FORESTED COUNTRY Writing thesis aims to understand efforts of fulfilling the right of indigenous the ground customary in the region forested country and constraints that have been faced in an effort to of fulfilling the right of indigenous the ground indigenous in forest area of state on indigenous Megou Pak Tulang Bawang Marga Suway Umpu ( The Community Talang Mountains) in a Register 45 River Crocodiles District Mesuji. Research methodology used approach normative and to complement the data interviews were conducted openly with the Head Of Forestry Sector In City Forestry District Mesuji.The data used in this research funded by primary data, data skunder and data tertiary. The result of this research showed efforts of fulfilling the right of constitutional indigenous Megou Pak Tulang Bawang Marga Suway Umpu ( The Community Talang Mountains) in a Register 45 River Crocodiles Mesuji has done with the request review the expansion of the register 45 river crocodiles by indigenous people to the Government District Mesuji and Minister Of Forestry to issued an enclave of 149,1 7000 ha ha and claimed as land customary by the community reduced an enclave will be managed with a partnership system but it has gained the opposition from the community customary.Efforts of fulfilling the right of has a problems of obstacles juridical, geographical and sociological.
