Anak adalah amanah sekaligus karunia Tuhan Yang Maha Esa, yang senantiasa harus dijaga karena dalam dirinya melekat harkat, martabat dan hak-hak sebagai manusia yang harus dijunjung tinggi. Hak asasi anak merupakan bagian dari hak asasi manusia yang termuat dalam Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 Pasal 28A sampai 28J, Konvensi Perserikatan Bangsa-Bangsa tentang Hak-Hak Anak Pasal 16 dan Undang-Undang Republik Indonesia 35 Tahun 2014 tentang Perubahan Atas Undang-Undang 23 Tahun 2002, tentang Perlindungan AnakBab III Pasal 4 sampai Pasal 19 mengenai Hak Anak. Fenomena merebaknya eksploitasi anak sebagai pengemis jalanan di Indonesia merupakan persoalan sosial yang komplek khususnya di Kota Bandar Lampung. Hal tersebut menunjukkan bahwa pemerintah khususnya Pemerintah Kota Bandar Lampung belum mampu mengatasi permasalahan anak jalanan yang dijadikan sebagai pengemis, sehingga masih marak terjadi kasus anak yang menjadi korban eksploitasi secara ekonomi yang menyebabkan hak-hak anak tidak dapat terpenuhi. Berdasarkan uraian di atas perludilakukan penelitian dengan rumusan permasalahan (1) Apakah yang menjadi faktor-faktor penyebab terjadinya Kejahatan Eksploitasi Anak sebagai Pengemis Jalanan. (2) Bagaimana upaya penanggulangan terhadap Kejahatan Eksploitasi Anak sebagai Pengemis Jalanan di Kota Bandar Lampung. Guna membahas permasalahan tersebut penulis dilakukan melalui penelitian dengan pendekatan normatif-empiris.Pengumpulan data dilakukan dengan studi pustaka dan studi Lapangan.Datanya selanjutnya dianalisis secara deskriptif kualitatif. Berdasarkan hasil penelitian dilapangan dapat diketahui bahwa faktor-faktor penyebab terjadinya kejahatan mengeksploitasi anak sebagai pengemis jalanan di Kota Bandar Lampung adalah Faktor Internal yaitu Kejiwaan/psikologis,Mental dan Moral, Agama sedangkan Faktor Eksternal yaitu Ekonomi, Faktor Urbanisasi, Faktor dorongan keluarga dan lingkunganya, Faktor rendahnya mental dan moral, Faktor rendahnya pendidikan, Faktor kurangnya kepedulian pemerintah dan masyarakat,sertafaktor lemahnya penegakan hukum.Upayapenanggulangan terhadapkejahatan mengeksploitasi anak sebagai pengemis jalanan di Kota Bandar Lampung dapat dilakukan dengan dua cara yaitu tindakan preventif yang harus di lakukan oleh setiap elemen, individu, masyarakat, dan pemerintah khususnya Dinas Sosial dengan pemanfaataan rumah singgah. Pemberdayaan para pengemis melalui rumah singgah sebagai solusi tepat sasaran ini dapat menjadi saran perbaikan mental serta moral terhadap pelaku eksploitasi anak untuk mengemis khususnya bagi permasalahan ekploitasi.Yang kedua yaitu melalui tindakan represif yang dilakukan oleh aparat penegak hukum dalam hal ini,Satuan Polisi Pamong Praja, Dinas Sosial serta lembaga non formal lain di Kota Bandar Lampung Penulis menyarankan agar diperlukanya adanya kerjasama antar instansi pemerintah maupun lembaga lain yang peka terhadap realitas yang terjadi di masyarakat dan tidak menutup mata terhadap kasus kejahatan eksploitasi yang menjadikan anak sebagai pengemis jalanan. Masyarakat sebaiknya juga meningkatkan kepedulian terhadap anak, bertanggungjawab secara moril terhadap pemenuhan hak-hak anak, tidak acuh terhadap kasus kejahatan eksploitasi. Pengelolaan rumah singgah yang efektif dan efisien dengan pendekatan yang komprehensif bagi institusi terkait, hal ini dilakukan agar pemberdayaan para pengemis serta anak jalanan dapat berjalan baik. Diharapkan adanya evaluasi pelaksanaan program pemberdayaan pengemis dan anak jalanan yang dikaji dalam penelitian untuk mengetahui tingkat keberhasilan Peraturan Daerah tersebut. Kata Kunci : Kejahatan, Eksploitasi Anak,Pengemis Jalanan ANALYSIS OF CRIMES AGAINST EXPLOITATION OF CHILDREN AS STREET BEGGARS ( STUDY IN BANDAR LAMPUNG) By Cornelius C.G Children are a gift of the mandate at the same time God Almighty, who should always be kept because in her inherent dignity, dignity and rights as a human being which must be upheld. Children's rights are part of human rights contained in the Constitution of 1945 section 28A to 28J, the Convention of the United Nations on the Rights of the Child Article 16 and the Law of the Republic of Indonesia Year 35 Year 2014 on the Amendment of the Law 23 of 2002, the Child Protection Section III, article 4 to article 19 of the Rights of the Child. Child Exploitation widespread phenomenon as street Beggar in Indonesia is a complex social problem, especially in the city of Bandar Lampung. It shows that the Government in particular, namely the Local Government Bandar Lampung has not been able to overcome the problems of street children in use as beggars, so rampant cases of children who are victims of economic exploitation that lead children's rights can not be fulfilled. Based on the description above authors conducted a study to determine (1) What are the factors that cause the occurrence of crimes Child Exploitation as Beggar Street.(2) How is the response of the Crime of Child Exploitation as Beggar Street in the city of Bandar Lampung. To discuss these problems the author conducted research with normative-empirical approach. The data collection is done through library research and field studies .Datanya then analyzed qualitative descriptive. Based on the research results in the field can be seen that the factors that cause the crime of exploiting children as street beggars in the city of Bandar Lampung is the internal factor, namely Psychiatric / Psychological, Mental and Moral, Religious whereas Factor ekstrenal namely Economy, Factor Urbanization, Factor family encouragement and lingkunganya, the causes of low mental and moral, lack of education factor, factor lack of government interest and communityas well as law enforcement lemanya factor.Crime prevention efforts in exploiting these children as street beggars in the city of Bandar Lampung can be done in two ways, namely preventive measures that should be done by each element, by individuals, communities, governments in particular . Empowerment beggars through hospice as an appropriate solution of this goal can be mental and moral improvement suggestions against the perpetrators of exploitation of children for begging, especially for the problems of exploitation. The second is through repressive measures undertaken by law enforcement officers in this case, the municipal police, social services and other non-formal institutions in the city of Bandar Lampung. The authors suggest that diperluka the cooperation between government agencies and other institutions are sensitive to the reality that is happening in the community and did not turn a blind eye to the crimes of exploit Society should also raise awareness of the child, morally responsible towards the fulfillment of children's rights, indifferent to the crime of exploitation ation to which children as street beggars. Management of shelters that effectively and efficiently with a comprehensive approach to the relevant institutions, this is done for the empowerment of beggars and street children can work well. Expected that the evaluation of the empowerment program beggars and street children were examined in the study to determine the rank of the success of the regional regulation.
