Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Notaris sebagai pejabat umum pembuat akta otentik, apabila dipanggil kepersidangan harus dengan persetujuan majelis pengawas daerah (MPD), akan tetapi pasca Putusan Mahkamah Konstitusi Nomor 49/PUU-X/2012 kewenangan tersebut menjadi kewenangan majelis kehormatan notaris (MKN). Pokok bahasan dalam penelitian ini adalah: (1) Kewenangan melakukan pembinaan dan pengawasan terhadap notaris pasca Putusan Mahkamah Konstitusi Nomor 49/PUU-X/2012. (2) Tugas dan fungsi majelis kehormatan notaris dalam melaksanakan pembinaan terhadap notaris pasca Putusan Mahkamah Konstitusi Nomor 49/PUU-X/2012. (3) Pertimbangan majelis kehormatan notaris dalam memberikan persetujuan atau menolak dilakukannya pemeriksaan terhadap notaris pada proses peradilan. Pendekatan masalah yang digunakan adalah pendekatan yuridis empiris. Data yang digunakan data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Pengumpulan data melalui studi pustaka, studi dokumen dan wawancara. Pengelolahan data dilakukan dengan cara pemeriksaan data, rekonstruksi data dan sistematisasi data. Selanjutnya, dianalisis secara kualitatif. Hasil penelitian ini menunjukkan bahwa kewenangan pemberian persetujuan terhadap pemanggilan notaris untuk proses peradilan dimiliki oleh majelis pengawas notaris, namun pasca Putusan Mahkamah Kosntitusi kewenangan tersebut dimiliki pula oleh MKN. MKN Pusat mempunyai tugas dan fungsi melaksanakan pembinaan dan pengawasan terhadap MKN Wilayah. MKN Wilayah melakukan pemeriksaan dan memberikan persetujuan atau penolakan dalam proses peradilan dan memberikan perlindungan kepada notaris terkait pembuatan akta. Pertimbangan MKN dalam memberikan persetujuan pemanggilan notaris untuk proses peradilan yaitu: apabila minuta akta dan/atau surat-surat notaris diduga berkaitan dengan tindak pidana, apabila hak menuntut belum gugur (daluwarsa) berdasarkan ketentuan hukum pidana, adanya penyangkalan keabsahan tanda tangan dari salah satu pihak atau lebih, adanya pengurangan dan penambahan minuta akta, adanya notaris melakukan pemunduran akta. Saran yang diharapkan dari penelitian ini adalah notaris memiliki kewajiban untuk merahasiakan isi akta, namun dalam kondisi tertentu kewajiban itu dapat dikesampingkan. jadi notaris harus lebih berhati-hati dalam menjalankan tugas nya. THE ROLE OF NOTARY HONORARY BOARD IN THE GUIDANCE OF NOTARY AFTER THE CONSTITUTIONAL COURT DECISION NUMBER 49/PUU-X/2012 Notary is the general official of the authentic deed of all deeds, If the notary is summoned to the court, it shall be subject to the approval of the notary supervisory board, but after the Constitutional Court Decision Number 49/PUU-X/2012 the authority becomes the jurisdiction of the notary honorary board. This study examines the role of notary honorary board in the guidance of a notary after the verdict of the constitutional court number 49/PUU-X/2012. The research problems in this research are formulated as follows: (1) Who is authorized to conduct guidance and supervision of the notary after the Constitutional Court Decision Number 49/PUU-X/2012 concerning Approval of the Regional Supervisory Board relating to the Judicial Process. (2) What are the duties and functions of the notary honorary board in carrying out guidance of the notary after the Constitutional Court Decision Number 49/PUU-X/2012 concerning Approval of the Regional Supervisory Board relating to the Judicial Process (3) What is the consideration of the notary honorary board in giving approval or rejecting the examination of the notary in the judicial process. This research is an empirical normative legal research with descriptive type. The approach used in this research was empirical approach. The data sources consisted of secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The data collection method was done through literature study, documentation and interviews. While the data management is done by data examination, data reconstruction and data systematization. Finally, the data were being analyzed qualitatively. The results and discussion of the research clearly showed that the authority to approve notary calls for the judicial process was owned by notary supervisory board. but after the Constitutional Court the authority becomes the jurisdiction of the notary honorary board. The Central MKN has the duties and functions of conducting guidance and supervision on Regional. The Regional MKN shall conduct examination and give approval or rejection to the requests submitted by law enforcement in judicial process and to give protection to notary in relation to notary's obligation to conceal the contents of deed. The consideration of MKN in giving approval of notarial notification for judicial process was when: the original of the deed and/or notary letters allegedly related to crime. If the right sue has not been declared under the penal law, the denial of the validity of the signatures of one or more parties, the reduction and the addition of the deed minus, the notary to do the deed. The expected suggestion from this research is that the notary has an obligation to conceal the contents of the deed, but under certain conditions the obligation can be disregarded. so the notary must be more careful in carrying out his duties.
