Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Kasus laka lantas yang melibatkan anak di wilayah hukum Polres Way Kanan yang menyebabkan tewasnya seorang pejalan kaki. Guna menangkal perselisihan kedua belah pihak Penyidik Kepolisian Laka Lantas Polres Way Kanan mengambil tindakan secara preventif dengan mejadi mediator mempertemukan kedua belah pihak. Permasalahan: a) Bagaimanakah penyelesaian perkara lalu lintas dengan tersangka anak melalui kearifan lokal di wilayah Polres Way Kanan?, b) Bagaimanakah kedudukan hukum dari penyelesaian perkara kecelakaan lalu lintas dengan tersangka anak melalui kearifan lokal di wilayah Polres Way Kanan? Pendekatan dalam penelitian ini menggunakan pendekatan kualitatif dengan tipe penelitian studi kasus, dimana pengumpulan data melalui wawancara mendalam, observasi, dan dokumentasi. Penyelesaian perkara lalu lintas dengan tersangka anak melalui kearifan lokal di wilayah hukum Polres Way Kanan telah dilaksanakan dengan adanya itikad baik serta rasa tanggung jawab tersangka anak dan keluarga dengan mendatangi keluarga korban sebagai upaya penyelesaian perkara kecelakan lalu lintas di luar hukum pidana dengan melibatkan Tokoh masyarakat, Aparat Desa dan Aparat Kepolisian Polres Way Kanan sebagai penengah dan saksi dalam penyelesaian proses perkara tersebut dengan jalan musyawarah damai, dimana adanya pernyataan dari keluarga tersangka memohon maaf atas peristiwa kecelakaan tersebut, kedua menyampaikan rasa turut berdukacita kepada keluarga korban, ketiga memberikan santunan atau biaya kerohiman kepada keluarga korban sebagai bentuk rasa pertanggungjawaban terhadap korban dan keluarga. Kedudukan hukum dari penyelesaian perkara lalu lintas dengan tersangka anak melalui kearifan lokal di wilayah hukum Polres Way Kanan sebaiknya tetap di tegakan meskipun ada peretanggungjawaban keluarga tersangka atau pelaku namun itu hanya untuk meringankan tuntutan pidana tidak menghilangkan atau menghapus unsur pidana tersebut. Kata Kunci : Kecelakaan lalu Lintas, Anak, Kearifan Lokal The Analysis Of Current Accidents Of Accidents In The Polres Way Kanan Region Children Through Local Wisdom (Case Study Report Number: LP/08.09/70/A/XI/ 2016/LL RES WK) The case of a past accident involving a child in the jurisdiction of Way Kanan Police led to the death of a pedestrian. To counter the dispute between the two sides of the Traffic Police Traffic Police investigator Way Kanan takes action in a preventive manner by being a mediator bringing the two sides together. Problems: a) How is the settlement of traffic matters with a child suspect through local wisdom in the Way Kanan Police area ?, b) What is the legal status of a traffic accident case settlement with a child suspect through local wisdom in the Way Kanan Police area? The approach in this study used a qualitative approach with case study research type, where data collection through in-depth interviews, observation, and documentation. The settlement of traffic incidents with child suspects through local wisdom in the jurisdiction of Way Kanan Police has been carried out in the presence of good faith and the sense of responsibility of the children and family by visiting the victim's family as an effort to solve the case of traffic accident outside the criminal law involving community leaders, Village Apparatuses and Police Officers of Way Kanan Police as mediators and witnesses in the settlement of the proceedings by peaceful deliberation, where the statement from the family of the suspect apologized for the accident, the two conveyed their sympathy to the victim's family, the third gave compensation or the cost of the kerohiman to the victim's family as a form of accountability for the victim and the family. The legal status of the settlement of traffic matters with the child suspect through local wisdom in the jurisdiction of Way Kanan Police should remain in the stand despite the accountability of the suspect family or the perpetrator but only to relieve the criminal charges does not eliminate or remove the criminal elements.
