Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Perbuatan main hakim sendiri (eigenrichting) merupakan perbuatan sewenang-wenang yang dilakukan oleh masyarakat atau orang banyak terhadap orang yang diduga melakukan suatu tindak pidana. Menghakimi sendiri para pelaku tindak pidana bukanlah merupakan cara yang tepat, melainkan merupakan suatu pelanggaran hak asasi manusia dan telah memberikan kontribusi negatif terhadap proses penegakan hukum. Permasalahan dalam tulisan ini bagaimanakah peranan penyidik terhadap main hakim sendiridan apakah faktor penghambat penyidik dalam melaksanakan peranannya terhadap perbuatan main hakim sendiri (eigenrichting).Pendekatan masalah yang digunakan dalam tulisan ini yuridis normatif dan yuridis empiris.Sumber data diperoleh dari studi kepustakaan dan studi lapangan. Analisis data kemudian dianalisis secara kualitatif untuk mendapatkan kesimpulan.Hasil penelitian dan pembahasan menunjukkan bahwa peranan penyidik dalam melaksanakan perannya terhadap perbuatan main hakim sendiri di wilayah Bandar Lampung sudah cukup baik pelaksanaannya walaupun tidak ada satupun pelaku main hakim sendiri yang diproses atau ditahan oleh pihak kepolisian.Faktor yang menjadi penghambat penyidik dalam melaksanakan peranannya terdiri atas faktor masyarakat yaitu kurangnya pengetahuan masyarakat akan peraturan yang ada, faktor sarana dan prasarana seperti tidak terjangkaunya kantor polisi dari lokasi kejadian perkara membuat terhambatnya laporan dari masyarakat serta terlambatnya penyidik menuju lokasi kejadian perkara, dan faktor kebudayaan yaitu perbuatan main hakim sendiri yang sudah menjadi kebiasaan terus-menerus merupakan budaya yang kurang baik dalam kehidupan bermasyarakat.Saran dari penelitian ini perlu adanya kesadaran hukum bagi masyarakat bahwa perbuatan main hakim sendiri tidak boleh dilakukan, penyidik sebagai aparat penegak hukum harus bertindak tegas dalam menghukum para pelaku tindak pidana atau pelaku kejahatan sehingga masyarakat merasa senang, aman dan dapat percaya dengan aparat penegak hukum, dan diharapkan. ABSTRACT The act of vigilante (eigenrichting) is an arbitrary act perpetrated by the public or the public against persons suspected of committing a crime. The vigilante against criminal offenses is not an appropriate way, but rather a violation of human rights and has contributed negatively to the process of law enforcement. The problems of this paper are formulated as follows: how is the role of investigators towards vigilente and what are the inhibiting factors towards vigilante (eigenrichting) by the investigators. The approaches of this research were carried out in form of normative and empirical approaches. The data sources were obtained from literature studies and field studies. The data analysis was being analyzed qualitatively to draw a conclusion. The results and discussion of the research showed that the role of investigators in carrying out their duty to tackle down the vigilante actions in the region of Bandar Lampung has been quite good although none of the vigilante perpetrators have been processed or detained by the police. Among some factors that hampered the investigators in performing their roles, included: community factors such as the lack of public awareness towards existing regulations, factor of facilities and infrastructures in form of inaccessibility of police stations from the scene of the crime has also hampered reports from the community and has made the investigators being late in reaching the crime scene, furthermore, the factor of local culture of creating vigilante has become a bad habit in social life. The author suggested that it is necessary to demand legal awareness for the community that the act of vigilante should has no place in the society, the investigators as law enforcement officers must take action firmly in imposing punishments to the perpetrators of criminal acts so that people will feel secure, comfortable, safe and trust the law enforcement officers.
