Abstrak

Hak Kekayaan Intelektual (HAKI) merupakan sistem di bidang ekonomi terutama industri, dan perdagangan internasional yang saat ini melekat pada tata kehidupan modern di setiap negara. Amerika Serikat mengusulkan Proposal for Negotiations on TRIPs Agreement untuk perlindungan HAKI ke dalam sistem perdagangan dunia yang disebut General Agreement on Tariffs and Trade (GATT). HAKI juga berpengaruh dalam organisasi regional ASEAN yang dimana tiap negara anggota ASEAN merupakan anggota dari World Trade Organization (WTO). TRIPs merupakan bagian dari WTO Agreement yang ditandatangani oleh negara-negara anggotanya yang mewajibkan seluruh anggotanya untuk membuat aturan-aturan mengenai HAKI di negara masing-masing. Adanya kesepakatan tentang TRIPs ini akan menimbulkan beberapa persoalan hukum, yakni pemasalahan yang berkaitan dengan HAKI yang banyak diatur dalam konvensi-konvensi intemasional yang diadministrasi World Intelectual Property Organization (WIPO). Oleh karena itu, tujuan dalam penelitian ini adalah untuk memahami praktik adopsi serta implementasi TRIPs Agreement yang dilakukan di Negara anggota ASEAN ke peraturan perundang-undangan nasional masing-masing negara. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan sumber data sekunder dan terdiri dari bahan hukum primer, sekunder, tersier serta menggunakan teknik studi kepustakaaan sebagai metode pengumpulan data. Pengolahan data dari penelitian ini adalah melalui perbandingan hukum antar negara-negara untuk mendapatkan proses praktik adopsi serta perbandingan implementasi TRIPs Agreement pada setiap negara anggota ASEAN. TRIPs Agreement mengatur tentang perlindungan HAKI sebagai isu-isu yang terkait di bidang perdagangan. HAKI merujuk pada semua kategori dari kekayaan intelektual yang diatur dalam isi Pasal TRIPs yaitu: Hak Cipta dan Hak Terkait (Pasal 9-14), Merek Dagang (Pasal 15-21), Indikasi Geografis (Pasal 22-24), Desain Industri (Pasal 25-26), Paten (Pasal 27-34), Desain Tata Letak (Topografi) Sirkuit Terpadu (Pasal 35-38), Perlindungan Informasi yang Dirahasiakan (Pasal 39), dan Perlindungan Praktik Anti Persaingan dalam Lisensi Kontrak (Pasal 40). Praktik adopsi TRIPs Agreement pada negara-negara anggota ASEAN secara otomatis meratifikasi perjanjian tersebut karena semua negara ASEAN merupakan anggota dari WTO. Sedangkan, implementasi TRIPs Agreement sebagaimana halnya perjanjian multilateral lainnya didasarkan pada ketentuan dan prinsip-prinsip umum GATT, yaitu: ketentutan Free in Determine, Ketentuan Intellectual Property Convention, ketentuan National Treatment, ketentuan Most Favoured National Treatment, dan ketentuan Exhaution. Dari semua ketentuan tersebut masing-masing negara mempunyai kebijakan nasional dalam proses implementasi TRIPs ke dalam peraturan perundang-undangan nasionalnya. THE IMPLEMENTATION OF TRIPS (TRADE RELATED ASPECTS OF INTELLECTUAL PROPERTY RIGHTS) AGREEMENT IN ASEAN REGIONAL COUNTRIES Intellectual Property Rights (IPR) is a system in the economic sector particularly in the international industry and trade which is currently attached towards the modern lives in each country. The United States proposed the Proposal for Negotiations on Trade-Related Aspects of Intellectual Property Rights (TRIPs) as an IPR protection into the world trading system or known as the General Agreement on Tariffs and Trade (GATT). The IPR has also influenced regional organization of ASEAN where each countries of ASEAN are also state members of the World Trade Organization (WTO) which is bound by an international agreement. TRIPs is a part of the WTO Agreement that is signed by its state members and obligates all of the state members to establish rules regarding to the IPR in each countries. The existing negotiation on TRIPs will cause law issues, one of them relates to intellectual property rights that are regulated in numerous international conventions administrated by the World Intellectual Property Organization (WIPO). Therefore, the purpose of this research is to understand the adoption practice and implementation of TRIPs agreement performed in each ASEAN state countries into their national regulation. The type of research used is normative-law with secondary data source consisting of primary, secondary, and tertiary law materials. This research uses literature study technique to collect data which then proceeds to process the data through law comparison between countries to achieve a comparison upon TRIPs adoption and implementation between member states of ASEAN. TRIPs Agreement regulates on IPR protection as issues relating to the trading sector. IPR refers to all categories on Intellectual Properties regulated in TRIPS which are: copyright and related rights (Article 9-14), trademarks (Article 15-21), geographical indications (Article 22-24), industrial designs (Article 25-26), patents (Article 27-34), layout-designs (topographies) of integrated circuit (Article 35-38), protection of undisclosed information (Article 39), and control of anti-competitive practices in contractual licenses (Article 40). The practice of TRIPs Agreement adoption in the ASEAN state members are automatically ratifications since all of the member states of ASEAN are also a member states of WTO. In the other hand, the implementation of TRIPs agreement such as other multilateral agreements is based on GATT’s general provisions that are: provision free in determine, provision of intellectual property convention, provision of national treatment, provision of most favoured national treatment, and provision of exhaution. Of all these provisions, each country has a national policy in the process of implementing TRIPs into their national legislation.
