Abstract

Rezim hukum pemilu dan pilkada selalu berkembang seiring dengan kebutuhan dalam masyarakat. Salah satunya ialah penambahan materi muatan mengenai pelanggaran administrasi terstruktur, sistematis, dan masif (TSM) sebagai bentuk baru dalam pelanggaran pemilu dan pilkada serta penyelesaiannya yang dilekatkan sebagai kewenangan Badan Pengawas Pemilihan Umum (Bawaslu). Menggunakan penelitian hukum normatif berbasis pendekatan konseptual, hasil penelitian menunjukan bahwa berdasarkan konsep dan praktik atas penyelesaian pelanggaran administrasi TSM saat ini, masih mengalami kekeliruan dalam konsep dan ketidakharmonisan antara hukum materil dan formil. Sehingga membutuhkan sumber hukum acara yang baru dalam bentuk Peraturan Bawaslu. Kata Kunci: Bawaslu, Hukum, Acara, Pelanggaran, TSM. Election law regimes has always evolved along with the needs in society. One of them is the addition of structured, systematic, and massive administrative violations (SSM Violation) as a new form in violations of elections and regional elections and their resolution which is attached as the authority of the General Election Supervisory Board (Bawaslu). Using normative legal research with using conceptual approach, the results of the study show that based on the concepts and practices of resolving administrative violations is currently experiencing errors in concepts and disharmony between material and formal law. So it requires a new source of procedural law in the form of the Bawaslu Regulation. Keywords: Bawaslu, Proceeding, Law, SSM Violation.
