Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Sengketa Laut Cina Selatan (LCS) merupakan sengketa yang melibatkan enam negara, yaitu Cina, Taiwan, Vietnam, Filipina, Brunei, dan Malaysia. Negara�negara tersebut menolak wilayah laut negara masing-masing yang diklaim secara keseluruhan oleh Republik Rakyat Cina (RRC). Pada 22 Januari 2013, Republik Filipina mengajukan gugatan terhadap RRC melalui the Permanent Court of Arbitration (PCA) atau Mahkamah Tetap Arbitrase Internasional atas klaim sepihak RRC di seluruh kawasan LCS yang termasuk wilayah perairan maritim Republik Filipina di dalamnya yaitu, Kepulauan Paracel, Spratly, dan Pratas, Macclesfield Bank, dan Scarborough Shoal. Penelitian skripsi ini bertujuan untuk mendeskripsikan penyelesaian sengketa LCS antara Republik Filipina dan Republik Rakyat Cina melalui PCA. Jenis penelitian yang digunakan dalam penulisan skripsi ini menggunakan penelitian hukum normatif, dengan sumber data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Penelitian skripsi ini menghasilkan dua temuan utama, pertama menjelaskan kompetensi PCA dalam menyelesaikan sengketa LCS, di mana PCA berkompetensi dalam menyelesaikan Sengketa LCS berdasarkan Pasal 287 ayat (1) Choice of Procedure dan Annex VII Arbitration, United Nations Convention on the Law of the Sea (UNCLOS). Kedua, menguraikan argumentasi hukum mengenai putusan PCA atas sengketa LCS dari pihak RRC dan Republik Filipina. Kata Kunci: Sengketa Internasional, Penyelesaian Sengketa Internasional, Sengketa Laut Cina Selatan, Permanent Court of Arbitration (PCA). The South China Sea (SCS) Dispute involves six countries which are Taiwan, Vietnam, Brunei, Malaysia, Philippines, and China. These countries are fighting over each of their sea territorial area which is claimed as a wholesome by the People’s Republic of China (PRC). On January 22, 2013 the Republic of Philippines filed a lawsuit against PRC for unilateral claims by China throughout the South China Sea region which are Paracel, Spratly, and Pratas Island, Macclesfield Bank, and Scarborough Shoal. The lawsuit filed by the Philippines was submitted through the Permanent Court of Arbitration (PCA). Therefore this paper aims to describe the competence of the Permanent Court of Arbitration in the South China Sea dispute settlement between the Republic of the Philippines and the PRC, and to figure out the legal arguments of the PCA in the South China Sea dispute between the Republic of the Philippines and the PRC. The research is used normative legal research with secondary data sources and consists of primary, secondary, tertiary legal materials. This research has 2 main study outcome, firstly explains that PCA has competence in SCS disputes settlement according to the Article 287 (1) Choice of Procedure and Annex VII Arbitration, United Nations Convention on the Law of the Sea (UNCLOS). The second results was closed with legal arguments from the parties involved in the dispute.
