Tindakan operasi (pembedahan) dapat menyebabkan kecemasan dan rasa sakit pada pasien akibat proses yang dilaksanakan. Tindakan pembiusan (anestesi) diperlukan oleh pasien untuk mengurangi, menghilangkan rasa sakit yang diderita. Tindakan anestesi pada pasien dilakukan oleh dokter anestesi. Tindakan anestesi pada pasien dapat dilakukan oleh penata anestesi selain dokter anestesi di rumah sakit. Permasalahan yang dibahas dalam penelitian ini yaitu tentang hubungan hukum dan pertanggungjawaban dokter anestesi terhadap tindakan operasi di rumah sakit dan akibat hukum dokter anestesi terhadap pelimpahan wewenang kepada dokter lain atau penata anestesi. Jenis penelitian yang digunakan adalah hukum normatif dengan tipe penelitian deskriptif. Data yang digunakan adalah data sekunder yang terdiri dari bahan primer, sekunder dan tersier. Pengumpulan data dilakukan melalui studi kepustakaan. Pengolahan data dilakukan dengan pemeriksaan data, rekonstruksi data, sistematis data dan penyusunan data yang selanjutnya dianalisis secara kualitatif. Hasil penelitian dan pembahasan menunjukkan, bahwa dokter anestesi sebagai tenaga medis profesional bertanggung jawab dalam setiap tindakan medis yang membutuhkan tindakan anestesi pada pasien. Bentuk pertanggungjawaban hukum dokter anestesi dapat dilihat dari segi hukum keperdataan, hukum pidana, dan hukum administrasi. Selanjutnya, dokter lain (dokter atau dokter spesialis) bertanggung jawab atas pelimpahan wewenang secara delegatif yang diberikan oleh dokter anestesi. Dokter anestesi bertanggung jawab atas pelimpahan wewenang yang diberikan kepada penata anestesi secara mandat apabila penata anestesi melaksanakan tindakan anestesi sesuai dengan instruksi yang diberikan dokter anestesi. Kata kunci: tanggung jawab, dokter, penata anestesi, anestesi. Surgery can cause anxiety and pain in patients due to the process carried out. Anesthesia in patients can be done by another doctor or anesthetist in addition to the anesthetist at the hospital. The problems discussed in this study are about the relationship between the law and the anesthesiologist’s responsibility for the operation in the hospital and the legal consequences of the anesthesiologist for delegating authority to another doctor or anesthetist. This research is normative legal study with research type is descriptive legal research, the approach of problems used is the empirical juridical approach, the data used is primary data and secondary data, data collection is done with library study, data processing done by data inspection, data reconstruction, data preparation and data analysis qualitatively. The results of the study and discussion showed that anesthetist as professional medical personnel are responsible for every medical action that requires anesthesia in patients. The form of anesthesiologist’s legal liability can be seen in terms of civil law, criminal law, and administrative law. Furthermore, other doctors (doctor or specialist doctors) are responsible for the anesthetic action carried out on delegative delegation of authority given by the anesthetist. The anesthetist is responsible for delegating authority given to the anesthetist by mandate if the anesthetist performs the anesthesia in accordance with the instructions given by the anesthetist.
