Abstrak

Penyebaran Corona virus Disease 2019 (Covid-19) yang semakin luas, membuat Pemerintah melakukan proses vaksinasi covid-19. Vaksin yang saat ini masih diberikan secara gratis oleh Pemerintah, dikhawatirkan akan melambung tinggi setelah masa pandemi berakhir. Compulsory licensing dapat digunakan oleh Pemerintah Indonesia untuk menghadapi permasalahan ini. Penelitian ini bertujuan untuk menganalisis dan memahami lebih lanjut mengenai bagaimana pelaksanaan compulsory licensing dapat diterapkan di Indonesia menurut ketentuan TRIPs Agreement. Rumusan masalah yang akan digunakan dalam penelitian ini ialah bagaimana pengaturan compulsory licensing di Indonesia berdasarkan aturan Doha Declaration serta bagaimana penerapan compulsory licensing berdasarkan aturan Doha Declaration sebagai upaya mendukung produksi vaksin Covid-19. Penelitian ini menemukan fakta bahwa compulsory licensing telah diatur di dalam ketentuan Undang-Undang tentang Paten dengan nama Lisensi Wajib dan Pelaksanaan Paten oleh Pemerintah. Pengaturan lisensi wajib tertuang dalam Pasal 81 hingga Pasal 107, dan untuk Pelaksanaan Paten oleh Pemerintah diatur di dalam Pasal 109 hingga Pasal 120. Kedua mekanisme tersebut, sejalan dengan ketentuan dari compulsory licensing yang tertuang di dalam ketentuan TRIPs Agreement dan Doha Declaration. Keselarasan antara Pelaksanaan Paten oleh Pemerintah dan Lisensi Wajib dengan compulsory licensing dapat dilihat dari kesamaan berikut; yakni penggunaannya dapat digunakan dan bermanfaat untuk kepentingan masyarakat luas, pengambilan lisensi telah dilakukan untuk jangka waktu tertentu dalam kondisi normal, wajib memberikan bayaran yang pantas terhadap Pemilik Paten, dapat dilakukan untuk kepentingan farmasi, terdapat otoritas untuk meninjau pelaksanaan paten, dapat digunakan untuk kebutuhan domestik maupun untuk di ekspor ke negara lain. Mekanisme compulsory licensing yang diatur dalam Undang-Undang tentang Paten sejauh ini belum diimplementasikan untuk produksi vaksin covid-19 di Indonesia. Pemerintah Indonesia memenuhi kebutuhan vaksin melalui impor vaksin dari negara lain dan juga kerjasama bilateral. Kedua upaya ini merupakan implementasi dari ketentuan Pasal 4 Peraturan Presiden Republik Indonesia Nomor 99 Tahun 2020 Tentang Pengadaan Vaksin Dan Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi Covid-19. Upaya ini sejalan dengan ketentuan Article 7 Doha Declaration yang memberikan kesempatan bagi negara untuk melakukan kerjasama dengan negara lain dalam memenuhi kebutuhan domestik. Untuk implementasi dari kerjasama internasional dengan lembaga dan negara lain upaya-upaya yang ditempuh oleh pemerintah Indonesia antara lain dengan melakukan pembelian vaksin kepada perusahan vaksin seperti oleh Sinovac Biotech Ltd, AstraZeneca, Moderna, Sinopharm, Pfizer Inc. and BioNTech, dan juga ikut serta dalam organisasi COVAX dalam pembuatan vaksin covid-19. Bentuk penerapan yang lain adalah dengan alih teknologi dari negara lain kepada Indonesia sebagai upaya mendorong percepatan produksi vaksin covid-19. Penerapan alih teknologi ini juga merupakan bentuk dari implementasi ketentuan compulsory licensing berdasarkan ketentuan Article 7 Doha Declaration dalam menyatakan komitmen dari negara-negara maju untuk memberikan insenstif alih teknologi kepada negara berkembang. Kata kunci : Vaksin Covid-19, Compulsory Licensing, Doha Declaration The spread of the Corona virus Disease 2019 (Covid-19) is getting wider, making the Government carry out the Covid-19 vaccination process. Vaccines, which are still being provided free of charge by the Government, are feared to soar after the end of the pandemic. Compulsory licensing can be used by the Government of Indonesia to deal with this problem. This study aims to analyze and further understand how the implementation of compulsory licensing can be applied in Indonesia according to the provisions of the TRIPs Agreement. The problem formulation that will be used in this research is how to arrange compulsory licensing in Indonesia based on the rules of the Doha Declaration and how to apply compulsory licensing based on the rules of the Doha Declaration as an effort to support the production of the Covid-19 vaccine. This study found the fact that compulsory licensing has been regulated in the provisions of the Law on Patents under the name Compulsory Licensing and Patent Implementation by the Government. Mandatory licensing arrangements are contained in Articles 81 to 107, and for the Government to use Patents are regulated in Articles 109 to 120. Both mechanisms are in line with the provisions of compulsory licensing as contained in the provisions of the TRIPs Agreement and the Doha Declaration. The harmony between the Government's Patent Implementation and Compulsory Licensing with compulsory licensing can be seen from the following similarities; i.e. its use can be used and is beneficial for the benefit of the wider community, licensing has been carried out for a certain period of time under normal conditions, must pay an appropriate fee to the patent owner, can be done for pharmaceutical purposes, there is authority reviewing the implementation of patents, can be used for domestic needs or for export to other countries. The compulsory licensing mechanism regulated in the Law on Patents has so far not been implemented for the production of COVID-19 vaccines in Indonesia. The Indonesian government fulfills the need for vaccines through imports of vaccines from other countries and also bilateral cooperation. These two efforts are the implementation of the provisions of Article 4 of the Presidential Regulation of the Republic of Indonesia Number 99 of 2020 concerning Vaccine Procurement and Vaccination Implementation in the Context of Overcoming the Covid-19 Pandemic. This effort is in line with the provisions of Article 7 of the Doha Declaration which provides opportunities for countries to cooperate with other countries in meeting domestic needs. For the implementation of international cooperation with other institutions and countries, the efforts taken by the Indonesian government include purchasing vaccines from vaccine companies such as Sinovac Biotech Ltd, AstraZeneca, Moderna, Sinopharm, Pfizer Inc. and BioNTech, and also participates in the COVAX organization in the manufacture of the covid-19 vaccine. Another form of application is the transfer of technology from other countries to Indonesia as an effort to accelerate the production of COVID-19 vaccines. The application of technology transfer is also a form of implementing compulsory licensing provisions based on the provisions of Article 7 of the Doha Declaration in declaring the commitment of developed countries to provide technology transfer incentives to developing countries Keywords: Covid-19 Vaccine, Compulsory Licensing, Doha Declaration.
