Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Pelaksanaan pengadaan tanah untuk pembangunan infrastruktur jalan tol telah diatur secara jelas dan rinci, tahapan pelaksanaan pengadaan tanah sesuai dengan peraturan perundang- undangan yang berlaku, namun pada kenyataannya masih terdapat beberapa permasalahan hukum yang sering muncul dalam proses akuisisi Tanah. Permasalahan yang akan dibahas dalam penelitian ini yaitu : Pertama, bagaimana dampak yang terjadi di masyarakat. kedua, apakah hak masyarakat telah terpenuhi. ketiga, kebijakan apa yang dilakukan pemerintah untuk melindungi masyarakat yang terkena dampak pengadaan tanah untuk pembangunan jalan tol ruas Terbanggi Besar-Pematang Panggang. Penelitian ini menggunakan pendekatan kualitatif untuk menganalisis suatu fenomena yang didukung oleh data yang diperoleh peneliti. Teori yang digunakan dalam penelitian ini adalah teori kebijakan publik, evaluasi kebijakan dan perlindungan hukum. Dampak yang terjadi karena pembangunan jalan tol Terbanggi Besar – Pematang Panggang dikalsifikasikan dari dampak tahapan pra kontruksi, kontruksi, dan operasi, yang dampaknya cukup beragam mulai dari segi fisk maupun segi sosial yang dialami masyarakat. Pemerintah telah menetapkan kebijakan untuk menaggulangi dampak yang terjadi di masyarakat akibat pembangunan jalan tol dan telah memenuhi hak-hak masyarakat secara hukum sesuai dengan peraturan perundang undangan bidang pengadaan tanah bagi pembangunan untuk kepentingan umum. Namun hak masyarakat belum sepenuhnya terpenuhi dengan adanya pembangunan ini dikrenakan tidak adanya kebijakan yang di keluarkan pemerintah daerah dalam menangani SDM (Sumber Daya Manusia) agar dapat bersaing dalam peningkatan ekonomi. Kata Kunci: Perlindungan Hukum, Pengadaan Tanah, Dampak Pembangunan Jalan Tol The implementation of land acquisition for the construction of toll road infrastructure has been regulated in a clear and detailed manner, the stages of land acquisition implementation are in accordance with applicable laws and regulations, but in reality there are still several legal problems that often arise in the land acquisition process. These are: First, how the impact that occurs in society. second, whether the rights of the community have been fulfilled. third, what policies did the government take to protect the affected communities. This study uses a qualitative approach to analyze a phenomenon that is supported by the data obtained by the researcher. The theory used in this research is the theory of public policy, policy evaluation and legal protection. The impacts that occur due to the construction of the Terbanggi Besar – Pematang Panggang toll road are classified from the impacts of the pre-construction, construction, and operation stages, the impacts of which are quite diverse, starting from the physical and social aspects experienced by the community. The government has established a policy to overcome the impacts that occur on the community due to the construction of toll roads and has fulfilled the legal rights of the community in accordance with the laws and regulations in the field of land acquisition for development in the public interest. However, the rights of the community have not been fully fulfilled with this development due to the absence of policies issued by the local government in dealing with human resources in order to compete in economic development.
