Perlindungan terhadap anak menjadi penting, karena anak merupakan penerus kehidupan berbangsa dan bernegara. Seperti pada salah satu contoh kasus Oknum Anggota Kepolisian Pelecehan Seksual Anak di Bawah Umur pada Polres Tulang Bawang. Namun, dalam implementasi semua perangkat kebijakan dan konvensi itu masih mengalami kendala, tantangan dan masalah. Permasalahan dalam skripsi ini adalah : Bagaimanakah upaya perlindungan hukum terhadap anak yang menjadi korban pelecehan seksual oleh Anggota Kepolisian. Dan apakah faktor penghambat yang di hadapi oleh Aparat Penegak Hukum dalam memberikan Perlindungan Hukum pada anak yang menjadi korban Pelecahan Seksual oleh Anggota Kepolisian. Pendekatan Masalah yang digunakan pada penelitian ini adalah pendekatan yuridis normatif dan yuridis empiris. Sumber data: Data Primer dan Data Skunder. Narasumber: Hakim Pengadilan Negeri Menggala, Kabid Perlindungan Perempuan & Anak pada Lembaga Perlindungan Anak dan Dosen Bagian Hukum Pidana Fakultas Hukum Universitas Lampung. Hasil penelitian dan pembahasan menunjukkan bahwa upaya perlindungan hukum terhadap anak yang menjadi korban pelecehan seksual oleh Anggota Kepolisian adalah dalam konteks perlindungan terhadap korban kejahatan, adanya upaya preventif maupun represif yang dilakukan. Upaya preventif ditekankan pada mengurangi kesempatan untuk dilakukannya tindak kekerasan seksual. Upaya represif ialah suatu dasar untuk menindak lanjuti pelaku kekerasan dengan berpedoman pada peraturan yang berkaitan. Dengan penerapan peraturan dan sanksi terhadap pelaku diharapkan agar pelaku memiliki efek jera dan tidak mengulangi kembali perbuatannya serta masyarakat lainnya tidak memiliki niat untuk melakukan hal yang sama. Proses pemeriksaan terhadap pelaku kejahatan, dari proses penyelidikan, penyidikan hingga pembuktian di persidangan oleh Hakim bahwa pada kasus tersebut Terdakwa di vonis dengan pidana penjara selama 7 (tujuh) Tahun pada tingkat pertama yaitu pada Pengadilan Negeri Menggala dan pada tingkat kasasi Terdakwa yaitu Mahkamah Agung di vonis dengan pidana penjara selama 8 (delapan) Tahun dan Terdakwa juga sudahdiberhentikan secara tidak hormat dari instansi Kepolisian dan telah menjalankan sidang kode etik Kepolisian. Faktor penghambat yang di hadapi oleh Aparat Penegak Hukum dalam memberikan Perlindungan Hukum pada anak yang menjadi korban Pelecahan Seksual oleh Anggota Kepolisian adalah dalam upaya kepolisian menanggulangi tindak pidana pelecehan seksual terhadap anak yang dilakukan oleh oknum anggota kepolisian memiliki faktor penegak hukum sebab pada proses penyidikan, dikarenakan pelakunya adalah oknum polisi sehingga penyidik harus benar-benar profesional dalam melaksanakan proses penyidikan yang merupakan titik pangkal pemeriksaan adalah tersangka karena dari tersangka diperoleh keterangan tentang peristiwa pidana yang sedang diperiksa. Saran dalam penelitian ini adalah bahwa bagi aparat penegak hukum, seharusnya mentaati aturan-aturan kepolisian serta dalam kode etik kepolisian, dapat melihat aturan-aturan disiplin kepolisian, sehingga anggota hendaknya menjaga martabat kepolisian dan selalu mentaati peraturan yang telah diterapkan di dalam UU No 2 Tahun 2002. Bagi masyarakat, jika anggota polisi melakukan tindak pidana maka harus ditindak tegas, sehingga tidak meresahkan masyarat sekitar, agar tidak menghilangkan kepercayaan masyarakat terhadap anggota polisi. Dalam rangka mewujudkan anggota polri yang profesionalisme maka setiap anggota Polri harus meningkatkan sumber daya manusia maupun di ikutkan dalam pelatihan-pelatihan yang dapat meningkatkan propesionalisme bagi anggota Polri secara pribadi maupun secara institusi. The rampant abuse of Komix cough medicine can be seen from the many packages of cough medicine found in places that are usually used as a gathering place for teenagers, hundreds of packages of Komix cough medicine sachets were found in packaged form. Komix cough medicine is used for hangover purposes and usually on weekend nights, wedding celebrations or other party celebrations. Narcotics Category III contained in Article 122 Paragraph (1) of Law Number 35 of 2009 concerning Narcotics. The problems in this thesis are: How are the efforts to overcome narcotics abuse of class III contained in the drug Komix among adolescents in the Lampung Regional Police area. And what are the inhibiting factors in efforts to overcome narcotics abuse of class III contained in the drug Komix among adolescents in the Lampung Regional Police area. Protection of children is important, because children are the continuation of the life of the nation and state. As in one example of the case of Underage Child Sexual Harassment Person, Tuba Polda Lampung Police. However, the implementation of all the policies and conventions still encounters obstacles, challenges and problems. The problems in this thesis are: How are legal protection efforts for children who are victims of sexual abuse by members of the police. And what are the inhibiting factors faced by Law Enforcement Officials in providing Legal Protection to children who are victims of Sexual Harassment by Members of the Police. Approach The problems used in this study are normative juridical and empirical juridical approaches. Data source: Primary Data and Secondary Data. Sources: Judge of the Menggala District Court, Head of the Protection of Women & Children at the Child Protection Agency and Academics of the Law Faculty of Criminal Law at the University of Lampung. The results of the research and discussion show that legal protection efforts for children who are victims of sexual abuse by members of the Police are in the context of protecting victims of crime, there are preventive and repressive efforts made. Preventive efforts are emphasized on reducing opportunities for acts of sexual violence to be committed. Repressive efforts are a basis for following up on perpetrators of violence based on relevant regulations, for example cases of sexual violence against children through cyberspace. With the application ofregulations and sanctions against perpetrators, it is hoped that perpetrators will have a deterrent effect and will not repeat their actions and that other people will not have the intention to do the same thing. Both by the community and the government (through law enforcement officials), such as providing protection/supervision from various threats that could endanger the lives of victims, providing adequate medical and legal assistance, the process of examining criminals. The suggestion in this study is that law enforcement officers should comply with police rules and the police code of ethics, be able to see police disciplinary rules, so that members should maintain the dignity of the police and always obey the rules that have been implemented in Law No. 2 of 2002. For the community, if a member of the police commits a crime, they must be dealt with firmly, so as not to disturb the surrounding community, so as not to lose the public's trust in members of the police. In the context of realizing professionalism of Polri members, each Polri member must improve human resources and be included in trainings that can increase the professionalism of Polri members personally and as an institution.
