Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Risalah Lelang menurut PMK 213/2020 ialah suatu akta autentik yang dibuat oleh atau di hadapan Pejabat Lelang menurut bentuk dan tata cara yang ditetapkan dalam undang-undang. Akta tersebut dibuat atas dasar permintaan pihak atau penghadap, yakni Pihak Penjual. Adanya pelaksanaan lelang secara elektronik (E-Auction) maka terjadi pembuatan akta Risalah Lelang tanpa sepengetahuan para pihak secara utuh atau lengkap, di mana pada saat pelaksanaan E-Auction tidak dihadiri peserta lelang secara langsung (kehadiran fisik). Hal tersebut tentunya telah menghilangkan esensi dari Pasal 1868 Kitab Undang-Undang Hukum Perdata mengenai akta autentik tentang “penghadapan”. Ketidakhadiran peserta lelang ini dimaknai sebagai ketidakhadiran secara fisik, namun dapat dihadiri melalui media elektronik. Penelitian ini akan mengkaji apakah Konstruksi Risalah Lelang dengan pelaksanaan E-Auction masih memenuhi unsur-unsur esensial dari Akta Autentik berdasarkan Pasal 1868 Kitab Undang-Undang Hukum Perdata dan bagaimanakah status pembuktian atas akta Risalah Lelang E-Auction tersebut bagi para pihak? Atas pemikiran tersebut, penulis akan meneliti dengan menggunakan metode pendekatan undang-undang, selain itu penulis juga meneliti pandangan-pandangan dan doktrin-doktrin berkenaan dengan akta autentik sebagai produk pejabat umum, khususnya dengan pejabat umum Notaris yang lebih matang konsepsinya dibandingkan dengan materi bidang lelang sebagai suatu kajian. Hasil penelitian menyatakan bahwa Risalah Lelang E-Auction dapat diakui sebagai akta autentik berdasarkan Pasal 1868 Kitab Undang-Undang Hukum Perdata yang memiliki kekuatan pembuktian sempurna secara lahiriah, formil dan materiil. Namun jika dikaitkan dengan ketentuan yang ada di dalam Undang-Undang Jabatan Notaris terdapat keraguan di dalam keautentikan Risalah Lelang yang tidak dibacakan bagian Kepala Risalah Lelang oleh Pejabat Lelang. Minutes of Auction according to PMK 213/2020 is an authentic deed made by or before the Auction Officer according to the form and procedure stipulated in the law. The deed is made at the request of the party or confronter, namely the Selling Party. The implementation of an electronic auction (E-Auction), there is a deed of Minutes of Auction without the knowledge of the parties as a whole or complete, where at the time of the E-Auction implementation the auction participants were not attended directly (physical presence). This certainly has eliminated the essence of Article 1868 of the Civil Code regarding authentic deeds regarding "face to face". The absence of bidders is interpreted as physical absence, but can be attended through electronic media. This research will examine whether the Construction of Minutes of Auction with the implementation of E-Auction still fulfills the essential elements of an authentic deed based on Article 1868 of the Civil Code and what is the evidentiary status of the E-Auction Minutes deed for the parties? For this reason, the author will be doing a research using the statutory approach method, besides that the author also examines the views and doctrines regarding authentic deeds as a product of public officials, especially with Notary public officials who are more mature in conception compared to the material of the auction field as a study. The results of the study state that the Minutes of E-Auction can be recognized as an authentic deed based on Article 1868 of the Civil Code which has perfect evidentiary power outwardly, formally and materially. However, if it is associated with the provisions in the Undang-Undang Jabatan Notaris, there are doubts in the authenticity of the Minutes of Auction that the Head of the Minutes of Auction is not read by the Auction Officer.
