Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

PT BSMI memiliki tanggungjawab sebagaimana diatur dalam UU No 39 Tahun 2014 tentang Perkebunan. Berdasarkan pada semangat dan arah untuk menguatkan investasi serta perekonomian nasional UU Perkebunan telah diubah berdasarkan pada UU No 11 Tahun 2020 tentang Cipta Kerja sebagaimana telah terakhir diubah melalui Peraturan Pemerintah Pengganti Undang-Undang No. 2 Tahun 2022 tentang Cipta Kerja. Pasal 27 PP No 18 Tahun 2021 tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun, dan Pendaftaran Tanah setidaknya dalam huruf i dan j menegaskan kembali terkait dengan fasilitasi lahan perkebunan rakyat. Dalam huruf i ditegaskan bahwa 20% itu merupakan luas tanah yang diberikan Hak Guna Usaha (HGU) yang dipegang oleh Perseroan Terbatas. Fokus pada penelitian ini untuk menjawab kedudukan PT BSMI sebagai pemegang tanggungjawab dan penyelesaian dalam pemenuhan hak masyarakat dalam plasma. Metode penelitian yang digunakan dengan pendekatan normatif dan yuridis. Hasil penelitian Perusahaan adalah penentu dari usulan dan terbentuknya plasma. Kondisi ini juga sangat mungkin terjadi dalam rezim UU Cipta Kerja dengan PP 26 Tahun 2021 yang masih menggunakan frasa fasilitasi. Lebih lanjut, kendala dari bentuk hubungan hukum antara masyarakat dan perusahaan sangat kabur dan penuh polemik. Masyarakat seringkali tidak mempunyai kesempatan untuk menentukan perwakilan maupun jenis kerjasama. Dalam PP penyelenggaraan pertanian juga kemungkinan untuk mengadakan kerjasama hingga adanya bantuan keuangan dalam skema investasi hanya dimungkinkan untuk badan hukum koperasi. Kedua, bagi masyarakat yang tuntutannya adalah ganti rugi (tanah, uang, dan pengelolaan) sangat sulit dipenuhi oleh PT BSMI. Kika masyarakat bertahan pada 35% lahan HGU kelapa sawit mungkin mereka dapat mengakses lahan. Namun belum tentu lahan tersebut dapat menghasilkan ataupun dapat dikelola dengan optimal. Kemampuan keuangan dan investasi sangat penting untuk keberlangsungan pengelolaan sawit masyarakat. Kata Kunci: HGU, Plasma, PT BSMI, Masyarakat   PT BSMI has responsibilities as regulated in Law No. 39 of 2014 concerning Plantations. Based on the spirit and direction to strengthen investment and the national economy, the Plantation Law has been amended based on Law No. 11 of 2020 concerning Job Creation, as last amended by Government Regulation in Lieu of Law No. 2 of 2022 concerning Job Creation. Article 27 PP No. 18 of 2021 concerning Management Rights, Land Rights, Flats Units, and Land Registration at least in letters i and j reaffirms related to the facilitation of smallholder plantation land. In letter i it is emphasized that 20% is the area of land granted with Cultivation Rights (HGU) held by a Limited Liability Company. The focus on this research is to answer PT BSMI's position as the holder of responsibility and settlement in fulfilling community rights in plasma. The research method used is a normative and juridical approach. The results of the Company's research are the determinants of the proposal and the formation of plasma. This condition is also very likely to occur in the regime of the Job Creation Law with PP 26 of 2021 which still uses the phrase facilitation. Furthermore, the constraints on the form of legal relations between communities and companies are very vague and full of polemics. Communities often do not have the opportunity to determine representatives or types of cooperation. In the PP on the implementation of agriculture it is also possible to enter into cooperation so that financial assistance in investment schemes is only possible for cooperative legal entities. Second, for people whose demands are compensation (land, money and management) it is very difficult for PT BSMI to fulfill. If the community stays on 35% of the oil palm HGU land, maybe they can access the land. But not necessarily the land can produce or can be managed optimally. Financial capacity and investment are very important for the sustainability of community oil palm management. Keywords: HGU, Plasma, PT BSMI, Community
