Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Kajian ini untuk menjawab permasalahan Netralitas Aparatur Sipil Negara (ASN) dalam Pemilu 2019. Undang-Undang Nomor 5 Tahun 2014 tentang ASN, idealnya seorang ASN harus netral dalam pemilu. Hal ini dilakukan karena sering terjadi kasus ASN yang diduga terlibat dalam politik saatPemilu di Kabupaten Pringsewu. Tujuan penelitian untuk menganalisis Netralitas ASN dalam Pemilu 2019 di KabupatenPringsewu dan mengetahui faktor yang mempengaruhi netralitas ASN dalam Pemilu 2019 di KabupatenPringsewu. Penelitian ini menggunakan Undang-Undang Nomor 5 Tahun 2014. Tipe penelitian yang digunakan penelitian deskriptif kualitatif. Metode pengumpulan data melalui wawancara,observasi,dan dokumentasi. Hasil penelitian ini menunjukan bahwa ASN dalam Pemilu 2019 di Kabupaten Pringsewu jika dilihat dalam UndangUndang Nomor 5 Tahun 2014,ASN di Kabupaten Pringsewu dinyatakan netral karena tahapan dugaan pelanggaran tindak pidana dan pelanggaran administratif tidak dilanjutkan ketahap penyidikan ataudihentikan dengan alasan tidak memenuhi unsur perbuatan tindak pidana dan pelanggaran administratif. Faktor yang mempengaruhi netralitas ASN dalam Pemilu 2019ditinjau dari kelembagaan.Ini diharapkan pelaksanaan netralitas PNS berjalan dengan baik dengan adanya pengawasan yang dilakukan oleh Bawaslu. Namun dalam kenyataannya seringkali terjadi keberpihakan birokrasi terhadap perpolitikan karena lemahnya pengawasan dan sanksi yang diberikan kepada para ASN yang melanggar aturan tersebut, jika dilihat dari non hukum faktor yang menyebabkan ASN tidak netral dalam pemilukarena adanya intervensi terhadap pengangkatan pejabat karir oleh pejabat politik dan adanya hubungan primordial serta ketidakpahaman terhadap regulasi ASN. Kata Kunci: Pelanggaran Kode Etik, Netralitas ASN, Pemilu This thesis aim is to answer the problem of Neutrality of Civil Servant (ASN) in the 2019 General Election.State Law No. 5 of 2014 concerning Civil Servant stated thata civil servant must be neutral in general election.This research wastaken because of the frequent cases of Civil Servant whowas involved in politics during elections in Pringsewu Regency. The aim of this research is to analyze the Neutrality ASN in the 2019 General Election of Pringsewu Regency and to analyze factors which influenced the neutrality ASN in the 2019 General Election of Pringsewu Regency. This study based on the State Law No. 5 of 2014. This research is a descriptive qualitative research. Data were collected through methods of interviews,observation,and documentation. The result of this study indicated that ASN in the 2019 General Election of Pringsewu Regency in the overview of Law Number 5 of 2014 is that ASN in Pringsewu Regency was declared neutral because the stages of alleged criminal offenses and administrative violations were not continued to the investigation stage or terminated by the reason of not fulfilling the elements of a criminal act and administrative violation.Factors which affected neutrality of Civil Servant in the 2019 General Election is in terms of institutions. It is hoped that the implementation of civil servant neutrality will be arranged with the supervision carried out by Bawaslu. However,in reality bureaucracy often takes sides with politics due to weak supervision and sanctions given to Civil Servants who violate these rules,when viewed from a non-legal perspective,the factors that cause Civil Servantwere not neutral in regional elections due to the intervention in the appointment of career officials by political officials and there is a primordial relationship and lack of understanding of Civil Servant regulations.
