Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
ABSTRAK Tindak pidana pelacuran mengalami perkembangan seiring kemajuan teknologi internet dalam bentuk prostitusi online. Pemberlakuan Undang-Undang Nomor 11 Tahun 2008 menjadi payung hukum penanggulangan prostitusi online. Kesenjangan hukumnya adalah tidak semua institusi Kepolisian Daerah mampu mengungkap praktik prostitusi online. Permasalahan penelitian ini adalah: (1) Bagaimanakah penegakan hukum terhadap prostitusi online sebagai tindak pidana pelacuran? (2) Apakah faktor-faktor yang menjadi penghambat penegakan hukum terhadap prostitusi online sebagai tindak pidana pelacuran? Pendekatan masalah yang digunakan adalah yuridis normatif dan yuridis empiris. Data penelitian dikumpulkan melalui studi pustaka dan studi lapangan. Selanjutnya data dianalisis data dilakukan secara kualitatif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan: (1) Penegakan hukum terhadap prostitusi online sebagai tindak pidana pelacuran yang dilakukan oleh Direktorat Reserse Kriminal Khusus Kepolisian Daerah Kepulauan Bangka Belitung dilaksanakan dengan proses penyidikan untuk mencari serta mengumpulkan bukti tentang tindak pidana prostitusi online dan untuk menemukan tersangkanya. Setelah penyidikan selesai dilaksanakan maka perkara dilimpahkan ke Kejaksaan dan Pengadilan untuk proses hukum selanjutnya sesuai dengan sistem peradilan pidana. (2) Faktor-faktor yang menjadi penghambat terdiri dari faktor hukum, faktor penegak hukum, faktor sarana dan fasilitas dalam penegakan hukum, faktor masyarakat dan faktor budaya. Faktor yang paling berpengaruh pada lemahnya penegakan hukum terhadap prostitusi adalah faktor penegak hukum. Hal ini disebabkan karena tidak semua penyidik memiliki latar belakang pendidikan hukum, kurangnya mekanisme kontrol dari komponen peradilan pidana, penegak hukum kurang menunjukkan keteladanan, tidak adanya unit cyber, penguasaan teknologi yang masih kurang, kerjasama penegak hukum antar negara yang belum efektif. Saran penelitian ini adalah: (1) Diperlukan komitmen dalam penegakan hukum terhadap kejahatan prostitusi online dan peningkatan kualitas penegak hukum baik penguasaan terhadap hukum, penggunaan bahasa asing dan bahasa hukum maupun sarana dan fasilitas. (2) Diperlukan sinergi antara kesadaran hukum dan kesadaran moral dari masyarakat dalam penegakan hukum terhadap prostitusi online. Kata Kunci: Penegakan Hukum, Prostitusi, Online ABSTRACT Criminal acts of prostitution had been developed with the progress of Internet technology in the form of online prostitution. Enforcement of Law No. 11 of 2008 as an umbrella law online prostitution prevention. Legal gap is not all regional police agency was able to uncover prostitution online. The problem of this research are: (1) How does law enforcement against online prostitution as a criminal offense prostitution? (2) What are the factors that constrain law enforcement against online prostitution as a criminal offense prostitution? The approach used is a juridical problem normative and empirical. The data were collected through library research and field studies. Furthermore, the data The data were analyzed qualitatively. Based on the results of research and discussion can be concluded: (1) Law enforcement against online prostitution as a crime committed by the Special Criminal Investigation Directorate of Bangka Belitung Islands Regional Police conducted the investigation process to search for and collect evidence on the crime of prostitution online and to find suspects . Once the investigation is completed, the case transferred to the Prosecutor and the Court for further proceedings in accordance with the criminal justice system. (2) Factors inhibiting factor consisting of legal, law enforcement factor, factor means and facilities in law enforcement, community factors and cultural factors. The most influential factor in the weak enforcement of laws against prostitution is a factor of law enforcement. This is because not all investigators have the educational background of the law, lack of control mechanisms of the components of the criminal justice, law enforcement fails to demonstrate exemplary, no cyber unit, mastery of technology is still lacking, law enforcement cooperation between countries that have not been effective. Suggestion of this research are: (1) It takes a commitment in law enforcement against crime online prostitution and improving the quality of law enforcement both mastery of the law, the use of a foreign language and the language of law and the means and facilities. (2) Required synergy between legal awareness and moral consciousness of society in the enforcement of laws against online prostitution. Keywords: Law Enforcement, Prostitution, Online
