Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Peralihan hak atas tanah dalam jual beli tanah harus dibuktikan dengan akta otentik yaitu sertifikat hak milik atas tanah sesuai ketentuan di dalam Peraturan Pemerintah Nomor 24 Tahun 1997, kegiatan jual beli tanah juga harus dilakukan di depan PPAT sebagai pejabat yang berwenang untuk menerbitkan akta Otentik mengenai peralihan hak atas tanah sesuai dengan ketentuan di dalam Peraturan Pemerintah Nomor 24 Tahun 2016, namun sebaliknya telah terjadi jual beli tanah di hadapan Kepala Desa dengan menggunakan surat ganti rugi tanah di Desa Sungai Raja. Permasalahan pada penelitian ini ialah : 1. Apakah Jual beli tanah dengan sarana surat ganti rugi tanah dari Kepala Desa dibenarkan menurut peraturan perundang undangan? 2.Bagaimanakah seharusnya jual beli tanah yang baik dan benar berdasarkan peraturan perundang undangan? Metode penelitian dilakukan dengan pendekatan normatif empiris melalui studi kasus dengan mengolah data melalui studi kepustakaan dengan menganalisis literatur yang relevan serta studi lapangan dengan metode wawancara dengan mengajukan pertanyaan kepada narasumber terkait. Hasil Penelitian ini ialah : 1.Jual beli tanah yang dilakukan di hadapan Kepala Desa dengan Surat Ganti Rugi Tanah dapat didasarkan kepada Permen ATR/BPN no 21 tahun 1994 dan oleh karena itu dapat dipertimbangkan untuk memindahkan haknya berdasarkan Pasal 37 ayat 2 PP No.24 Tahun 1997 2. Jual beli tanah dapat dilakukan di hadapan PPAT untuk diterbitkan akta otentik berupa Akta Jual Beli,dengan Akta tersebut pembeli tanah kemudian dapat melakukan prosedur balik nama pada Sertifikat Hak Milik atau dengan pertimbangan Kepala Badan Pertanahan dapat langsung dilakukan peralihan hak berdasarkan Surat Ganti Rugi Tanah Kata Kunci : Jual Beli,Surat Ganti Rugi Tanah,PPAT The transition of right in action of purchasing land must be proven by authentic deed as land sertificate according to the provisions in Government Regulation Number 24 of 1997, the action in purchasing a land should done in front of Government officials which had the authority to put in print the authentic deeds about land purchasing in accordance with the provisions in Government Regulation Number 24 of 2016, but on the contrary in the Sungai Raja Village there has been a sale and purchase of land before the Village Chief using a letter of land compensation. The question of this research is : 1. Is the sale and purchase of land by means of a letter of compensation for land from the village head justified according to statutory regulations? 2. How should a good and correct land sale and purchase be based on statutory regulations? The Scientific methods used in this research is empirical normative through case studies by processing data through literature studies by analyzing relevant literature as well as field studies using the interview method by asking questions to relevant informants. The result of this research : 1.The Sale and purchase of land carried out before the village chief can be done with Minister of land regulation Number 21 of 1994 and therefore the sale and purchase of land can be considered legal with article 37 Government Regulation Number 24 of 1997. 2.The purchase of lad can be done with the land official with the transfer of title procedure aswell without the land official the sale and purchase of land can be done with the consideration of the head of the department of land to transfer it with by including the name of the land buyer directly on the land certificate Keyword : Sale And Purchase,Compensation Letter,Land Official
