Abstract
ABSTRAK Tujuan penulisan ini adalah untuk menganalisis proses penyerahan aset daerah dan sengketa aset daerah antara pemerintah Kabupaten Lampung Tengah dan pemerintah Kota Metro, serta menganalisis proses penyelesaian sengketa aset daerah akibat terbentuknya Kota Metro sebagai pemekaran Kabupaten Lampung Tengah. Penelitian ini dilakukan dengan penelitian naormatif empiris yaitu dengan mempelajari peraturan perundang-undangan serta menggambarkan data hasil penelitian mengenai terjadinya sengketa dan penyelesaian sengketa aset daerah serta melakukan wawancara dengan narasumber. Hasil penelitian menunjukan bahwa: Sengketa asset daerah antara Kabupaten Lampung Tengah dan Kota Metro terjadi karena; Adanya kesepakatan atau MoU yang dibuat oleh kedua belah pihak tidak sesuai dengan Kepmendagri No. 42 Tahun 2001, adanya perbedaan pendapat antara pemerintah Kabupaten Lampung Tengah dan Pemerintah Kota Metro mengenai proses penyerahan asset daerah yang harus mendapat persetujuan DPRD. Penyelesaian sengketa telah dimediasi oleh Pemerintah Daerah Provinsi Lampung namun sampai saat ini sengketa aset Kabupaten Lampung Tengah dan Kota Metro masih menjadi polemik. ABSTRACT The purpose of this paper is to analyze the process of handing over the assets of the district and county asset dispute between the government and the governments of Central Lampung District Metro City, as well as analyze the mediation process as a result of the formation of regional assets Metro city as the expansion of Central Lampung regency. The research was conducted with the empirical research that is by learning normatif legislation and describes the results of research data on the occurrence of conflict and dispute resolution district assets and doing interviews with sources. The results of this research showed that: Dispute between county assets and Central Lampung regency occurred because Metro City; The existence of an agreement or MoU made by both parties does not correspond to Kepmendagri No.42 of 2001, the difference of opinion between the government and Central Lampung District Municipality of Metro on asset submission process area must be approved by the Parliament. Dispute resolution was mediated by the Regional Government of Lampung Province, but to date the asset disputes Central Lampung District and the City Metro is still a polemic.
