bahwa perbuatannya tersebut benar walaupun melanggar hukum. Kemudian, untuk menentukan terdakwa dapat bertanggungjawab atau tidak tergantung pada keyakinan hakim terhadap alat bukti yang sah. Karena apapun yang menjadi putusan hakim harus dianggap benar sesuai dengan prinsip res judicata pro veritate habetur (putusan hakim harus dianggap benar). Saran dalam penulisan ini yaitu harus adanya kerjasama antara aparat penegak hukum dan dokter spesialis jiwa untuk menilai psikis seorang terdakwa sehingga dapat diberikan putusan yang adil dan sesuai dengan kondisi kejiwaannya. Serta perlu dukungan dari masyarakat terhadap orang-orang disekitarnya yang mengalami gangguan jiwa dan perlu menghilangkan stigma negatif masyarakat terhadap orang gangguan kejiwaan. Sehingga orang yang mengalami gangguan jiwa tidak merasa dikucilkan dan diasingkan. Kata Kunci: Pertanggungjawaban Pidana, Skizofrenia Paranoid, Pertimbangan Hakim. Criminal acts are not only committed by normal people, but some criminal acts are committed by defendants who suffer from mental disorders as contained in Decision Number: 288/Pid.B/2020/PN.Pms, where the defendant committed a criminal offense that caused the loss of life of another person, is punishable by Article 388 of the Criminal Code. Then there is a Visum et Repertum which states that the defendant has severe mental disorders, namely Paranoid Schizophrenia, but the judge sentenced him to 13 years in prison. The problems that are the subject of this research are How is the criminal responsibility of the perpetrator of the crime of murder who has a mental disorder and What is the basis for the judge's consideration in deciding the case with criminal punishment against the perpetrator of the crime of murder who has a mental disorder. The research method in this writing is using a normative juridical approach. The resource persons in this research are Mental Specialist Doctors at the Lampung Provincial Mental Hospital and Lecturers of the Criminal Law Section of the Faculty of Law, University of Lampung. Data collection analysis with literature studies and field studies was conducted qualitatively. The results of this study are that to be criminalized a person must fulfill objective and subjective requirements. subjective requirements contain elements of guilt, and it is this guilt that gives rise to criminal liability. Paranoid Schizophrenia type of mental disorder that makes the sufferer experience hallucinations that make it difficult to distinguish between reality and delusion. When the perpetrator of a criminal offense is a person with a mental disorder, what must be considered is whether the defendant was under the influence of his mental disorder when he committed the criminal offense. In this case, the defendant was under the influence of a mental disorder when he committed the crime, as evidenced by the fact that after committing the crime, the defendant did not feel guilty because he thought that his actions were right even though they violated the law. Then, determining whether the defendant is liable or not depends on the judge's belief in the valid evidence. Because whatever the judge decides must be considered true by the principle of res judicata pro veritate habetur (the judge's decision must be considered true). The suggestion in this writing is that there must be cooperation between law enforcement officials and psychiatric specialists to assess the psychology of a defendant so that a fair decision can be given on his mental condition. As well as the need for support from the community for people around them who experience mental disorders and the need to eliminate the negative stigma of the community towards people with mental disorders. So that people who experience mental disorders do not feel ostracized and alienated. Keywords: Criminal Liability, Paranoid Schizophrenia, Judges' Consideration.
