Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Dalam konteks kehidupan bersama sebagai sebuah bangsa dan negara, anak-anak dianggap sebagai pilar utama masa depan bangsa juga generasi yang akan mewarisi cita-cita bangsa. Oleh karena itu, setiap anak memiliki hak guna melanjutkan hidup, tumbuh, berkembang, berpartisipasi, juga mendapatkan perlindungan dari segala bentuk kekerasan dan diskriminasi, selain hak-hak sipil dan kebebasan yang mereka miliki. Dengan maraknya kasus pencabulan anak yang terjadi, Jaksa Penuntut Umum memiliki peran penting dalam upaya menciptakan keadilan dan mempertimbangkan kepentingan korban serta masyarakat. Mereka merupakan pejabat yang diberi wewenang oleh undang-undang guna bertindak selaku penuntut umum serta menjalankan putusan pengadilan yang sudah mendapat kekuatan hukum tetap. Selain menggunakan dasar pertimbangan yang objektif beserta subjektif, Jaksa Penuntut Umum juga melihat dampak akibat dari tindak pidana tersebut, faktor psikologi korban, serta mempertimbangkan kepentingan korban dan masyarakat. Penelitian ini menggunakan metode gabungan antara penelitian hukum normatif dan penelitian hukum empiris. Sumber hukum yang dipergunakan melibatkan bahan hukum primer juga sekunder, bersama dengan bahan hukum lainnya yang didapat melewati teknik argumentasi, deskripsi, juga evaluasi guna mendukung penyusunan karya ilmiah ini. Proses pengolahan data dilakukan dengan menerapkan teknik analisis kualitatif normatif. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwasanya selain melalui penggunaan dasar pertimbangan objektif dan subjektif, Jaksa penuntut umum juga melihat dampak akibat dari tindak pidana tersebut, faktor psikologi korban, serta mempertimbangkan kepentingan korban dan Masyarakat. Pada dasarnya demi mencapai keseimbangan masyarakat, penuntut umum harus melihat kasus ini secara umum, memperhatikan dampak terhadap masyarakat dan bukan lagi pada korban. Penuntutan kasus pencabulan anak mengenai keseimbangan kepentingan korban dan masyarakat dapat lebih difokuskan pada analisis peran jaksa penuntut umum dalam menyeimbangkan kepentingan korban dan masyarakat dalam kasus-kasus pencabulan anak. Tulisan ini diharapkan dapat mencakup tinjauan terhadap proses penuntutan, kewenangan jaksa penuntut umum, serta implementasi prinsip-prinsip hukum dan keadilan dalam menangani kasus-kasus sensitif seperti pencabulan anak. Selain itu, tulisan ini juga diharapkan dapat mempertimbangkan perspektif peran Jaksa dalam konteks penuntutan terhadap anak yang menjadi korban tindak pidana khususnya pencabulan. Kata Kunci : Penuntut Umum, Anak, Pencabulan Anak, Kepentingan korban dan masyarakat From the perspective of nation-building and governance, children are the future of the nation and the next generation to carry on the nation's aspirations, so every child has the right to survival, growth, and development, to participate, and to be protected from violence and discrimination as well as civil rights and freedoms. With the increasing cases of child molestation, the Public Prosecutor plays a significant role in creating justice and considering the interests of the victim and the community. The Public Prosecutor is an official authorized by law to act as a public prosecutor and to enforce court decisions that have obtained permanent legal force. In addition to using objective and subjective considerations, the public prosecutor also considers the impact of the crime, the victim's psychological factors, and the interests of the victim and the community. The method used in this study is normative and empirical legal research methods. The study utilizes primary legal materials, secondary legal materials, and additional legal materials acquired through the application of argumentation, description, and evaluation techniques, all of which contribute to the development of this scholarly work. Subsequently, the data processing involves the use of normative qualitative analysis processing techniques. Based on the results of the research and discussion, it can be concluded that in addition to using objective and subjective considerations, the public prosecutor also considers the impact of the crime, the victim's psychological factors, and the interests of the victim and the community. Basically, to achieve a balance in society, the public prosecutor must look at this case in general, pay attention to the impact on society and not just on the victim. The prosecution of child abuse cases regarding the balance of interests between the victim and society can be more focused on analyzing the role of the public prosecutor in balancing the interests of the victim and society in cases of child abuse. This article is expected to include a review of the prosecution process, the authority of the public prosecutor, and the implementation of legal principles and justice in handling sensitive cases such as child abuse. Additionally, this article is also expected to consider the perspective of the role of the prosecutor in the context of prosecuting children who become victim of criminal acts especially on child abuse.
