Penelitian ini bertujuan untuk membahas dan mengkaji mengenai pengelolaan tanah yang dimiliki pemerintah desa sesuai dengan amanat Peraturan Dalam Negeri Nomor 1 Tahun 2016 tentang Pengelolaan Aset Desa. Selain itu, penelitian ini akan mengkaji bagaimana mekanisme dan bentuk perjanjian yang digunakan daalam proses hibah yang melibatkan obyek tanah kas desa, khususnya di daerah Pekon Rejosari, Kecamatan Pringsewu, Provinsi Lampung. Perjanjian hibah yang dikaji dibuat antara Pemerintah Desa Pekon Rejosari dengan Dinas Kesehatan Provinsi Lampung untuk pembangunan Pusat Kesehatan Masyarakat (PUSKESMAS). Dengan demikian penelitian dapat berfungsi untuk mengetahui bagaimana pelaksanaan hibah tanah kas desa dan bentuk perjanjian yang dibuat. Penelitian ini mekanisme hibah tanah kas desa dan bentuk perjanjian yang dibuat. Penelitian ini berjenis normatif empiris dengan mengkaji langsung data dari lapangan dan pengambilan keterangan dari wawancara langsung pihak yang berkaitan. Untuk mendapatkan hasil penelitian ini digunakan analisis data deskriptif untuk untuk memecahkan masalah dalam penelitian. Hasil penelitian menyatakan bahwa perjanjian diantara pemerintah desa di Pekon Rejosari sebagai pemilik tanah kas desa dengan Dinas Kesehatan dianggap sah karena dibuat dalam bentuk tertulis meskipun perjanjian yang terjadi pada tahun 2018 telah menyimpang dari aturan yang berlaku. Kata Kunci : Hukum Perjanjian, hibah, tanah kas desa, pengelolaan aset desa. This research aims to discuss and examine the management of land owned by the village government in accordance with the mandate of Domestic Regulation Number 1 of 2016 concerning Village Asset Management. Apart from that, this research will examine the mechanisms and forms of agreements used in the grant process involving village treasury land objects, especially in the Pekon Rejosari area, Pringsewu District, Lampung Province. The grant agreement studied was made between the Pekon Rejosari Village Government and the Lampung Provincial Health Service for the construction of a Community Health Center (PUSKESMAS). In this way, research can function to find out how village treasury land grants are implemented and the form of agreement made. This research examines the mechanism the village treasury land grant mechanism and the form of agreement made. This research is an empirical normative type by directly examining data from the field and taking information from direct interviews with related parties. To obtain the results of this research, descriptive data analysis was used to solve problems in the research. The research results stated that the agreement between the village government in Pekon Rejosari as the owner of the village treasury land and the Health Service was considered valid because it was made in written form even though the agreement that occurred in 2018 had deviated from the applicable regulations.
