Kesehatan merupakan salah satu faktor utama dalam mencapai kesejahteraan suatu negara. Pemenuhan hak kesehatan termasuk dalam hak asasi manusia yang harus dipenuhi, hal ini tertera pada Pasal 28H UUD 1945. Salah satu upaya negara dalam peningkatan kualitas kesehatan untuk terpenuhinya hak dasar manusia yaitu dengan melaksanakannya program jaminan kesehatan bagi warga negaranya melalui Badan Penyelenggara Jaminan Sosial (BPJS) Kesehatan. Akan tetapi peserta BPJS Kesehatan masih terdapat mengalami keluhan saat mendapatkan pelayanan di salah satu rumah sakit swasta (RS Amanda) yang ada di Kabupaten Bekasi. Penelitian ini bertujuan untuk mengetahui bagaimana pemenuhan hak peserta BPJS Kesehatan oleh Rumah Sakit Amanda Kabupaten Bekasi dan untuk mengetahui implikasi hukum yang terjadi di Rumah Sakit Amanda Kabupaten Bekasi jika tidak memenuhi hak dan kewajiban peserta BPJS Kesehatan. Penelitian ini menggunakan metode penelitian hukum normatif empiris, yaitu menganalisis peraturan perundang-undangan dan literatur hukum serta meneliti secara langsung ke lapangan. Data yang digunakan adalah data primer dan data sekunder serta pengumpulan data menggunakan studi kepustakaan, studi lapangan dan dokumentasi. Pengolahan data dilakukan dengan cara pemeriksaan data, klasifikasi data dan penyusunan data. Hasil penelitian ini menunjukan bahwa RS Swasta di Kabupaten Bekasi (RS Amanda) dalam hal pemenuhan hak kesehatan yang diberikan kepada peserta BPJS Kesehatan sudah baik. Para peserta BPJS Kesehatan sudah mulai terpenenuhi haknya dan tidak adanya diskriminasi antara pasien umum dan pasien BPJS Kesehatan. Implikasi hukum yang terjadi jika rumah sakit tidak memenuhi hak peserta BPJS Kesehatan yaitu pemutusan kerjasama yang dilakukan oleh BPJS Kesehatan kepada rumah sakit jika melakukan fraud (kecurangan) atau tidak memenuhi hak peserta BPJS Kesehatan sehingga peserta merasa tidak puas dalam hal pelayanan kesehatan. Oleh karena itu, penyelenggara jaminan kesehatan nasional ini harus tetap memperhatikan aspek keadilan, anti diskriminasi dan tidak membedakan antara peserta BPJS dengan pasien umum.. The fulfillment of health rights is included in human rights that must be fulfilled, this is stated in Article 28H of the 1945 Constitution. One of the state's efforts in improving the quality of health for the fulfillment of basic human rights is by implementing a health insurance program for its citizens through BPJS Kesehatan. The implementation of this program has gone well, but BPJS Kesehatan participants still experience complaints when getting services at one of the private hospitals in Bekasi Regency. This study aims to determine how the fulfillment of the rights of BPJS Health participants by Private Hospitals in Bekasi Regency and to find out the legal implications that occur in Private Hospitals if they do not fulfill the rights and obligations of BPJS Health participants. The research method used is empirical normative legal research, namely analyzing laws and regulations and legal literature and researching directly into the field, with a qualitative descriptive analysis research type. The data used are primary data and secondary data and data collection using literature studies, field studies and documentation. Data processing is done by examining data, classifying data and compiling data. The results of this study indicate that private hospitals in Bekasi Regency (Amanda Hospital) in terms of fulfilling health rights provided to BPJS Health participants are good. BPJS Health participants have begun to fulfill their rights and there is no discrimination between general patients and BPJS Health patients. The legal implications that occur if the hospital does not fulfill the rights of BPJS Health participants are termination of cooperation carried out by BPJS Health to the hospital if it commits fraud (fraud) or does not fulfill the rights of BPJS Health participants so that participants feel dissatisfied in terms of health services. Therefore, the organizers of this national health insurance must continue to pay attention to aspects of justice, anti-discrimination and not distinguish between BPJS participants and general patients.
