Perjanjian surogasi secara eksplisit belum diatur dalam peraturan perundangundangan. Di dalam praktik, surogasi semakin banyak dilaksanakan sebagai alternatif untuk memiliki anak. surogasi menjadi topik yang kompleks karena melibatkan berbagai aspek hukum dan sosial. Perjanjian surogasi sering kali terkait dengan asas kebebasan berkontrak yang memungkinkan individu untuk membuat perjanjian sesuai dengan keinginan mereka. Penelitian ini bertujuan untuk mengkaji regulasi surogasi di Indonesia, serta implementasi asas kebebasan berkontrak dalam perjanjian surogasi. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perbandingan, pendekatan konsep, dan pendekatan undang-undang. Data yang digunakan meliputi bahan hukum primer, sekunder, dan tersier yang diperoleh melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa meskipun perjanjian surogasi belum diatur secara hukum di Indonesia, praktik ini masih berlangsung secara diam-diam. Implementasi asas kebebasan berkontrak dalam perjanjian surogasi di Indonesia dipengaruhi oleh faktor-faktor sosial dan budaya yang melarang praktik surogasi. Dari sisi hukum, perjanjian surogasi harus tunduk pada pembatasan yang ditetapkan oleh Pasal 1320, 1337, dan 1338 Kitab Undang-Undang Hukum Perdata (KUHPerdata) yang mencakup syarat sahnya perjanjian, tujuan yang diperbolehkan, serta asas kebebasan berkontrak yang tidak boleh bertentangan dengan hukum, ketertiban umum, dan kesusilaan yang berlaku, sehingga perjanjian surogasi batal demi hukum. Kata Kunci: Asas Kebebasan Berkontrak, Perjanjian Surogasi, Sewa Rahim. Surrogacy agreements are not explicitly regulated in Indonesian legislation. In practice, surrogacy is increasingly being carried out as an alternative for couples who have difficulty conceiving. Surrogacy is a complex topic as it involves various legal and social aspects. Surrogacy agreements are often associated with the principle of freedom of contract, which allows individuals to create agreements according to their preferences. This study aims to examine surrogacy regulations in Indonesia and evaluate the implementation of the principle of freedom of contract in surrogacy agreements. This research employs a normative legal research method with a comparative approach, a conceptual approach, and a statutory approach. The data used include primary, secondary, and tertiary legal materials obtained through literature studies. The research results indicate that although surrogacy agreements are not legally recognized in Indonesia, the practice continues to occur covertly. The implementation of the principle of freedom of contract in surrogacy agreements in Indonesia is influenced by social and cultural factors that prohibit surrogacy practices. From a legal perspective, surrogacy agreements must comply with the restrictions stipulated in Articles 1320, 1337, and 1338 of the Indonesian Civil Code (KUHPerdata), which include the validity requirements of agreements, permissible objectives, and the principle of freedom of contract that must not conflict with applicable law, public order, and morality.
