Abstract
Mediasi adalah alternatif penyelesaian sengketa di luar pengadilan yang bertujuan mencapai win-win solution bagi semua pihak. Dengan kebutuhan akan penyelesaian yang cepat dan efisien, mediasi diterapkan dalam berbagai konteks, termasuk hukum keluarga. Penelitian ini merumuskan bagaimana (1)efektivitas mediator non hakim dalam mediasi pembagian harta bersama di Pengadilan Agama Tanjung Karang, (2) serta tantangan dan faktor yang mempengaruhi keberhasilan proses tersebut. Penelitian ini menggunakan metode hukum normatif terapan dengan tipe deskriptif, yang fokus pada efektivitas mediator non-hakim dalam mediasi pembagian harta bersama di Pengadilan Agama Tanjung Karang. Data dikumpulkan melalui studi kepustakaan dan wawancara, dengan analisis deskriptif analitik terhadap bahan hukum primer, sekunder, dan tersier. Hasil penelitian ini menganalisis efektivitas mediator non-hakim dalam mediasi pembagian harta bersama di Pengadilan Agama Tanjung Karang. Meskipun jumlah perkara menurun, tingkat keberhasilan mediasi juga menurun tajam, dengan hanya 1,54% perkara yang berhasil diselesaikan pada 2024. Faktor penghambat meliputi kendala pembuktian, komunikasi, dan masalah emosional pihak yang bersengketa, sementara faktor pendukung mencakup dukungan institusional, keterbukaan pihak terkait, dan keahlian mediator. Untuk meningkatkan efektivitas mediasi, diperlukan sosialisasi manfaat mediasi guna meningkatkan partisipasi masyarakat serta penguatan pelatihan bagi mediator non-hakim, terutama dalam teknik mediasi, komunikasi, dan penanganan aspek psikologis sengketa, dengan dukungan tenaga ahli seperti psikolog. Kata Kunci: Mediator, Efektivitas, Harta Bersama Mediation is an alternative dispute resolution outside of court that aims to achieve win-win solution for all parties. With the need for quick and efficient resolution, mediation is applied in a variety of contexts, including family law. This research formulates how (1) the effectiveness of non-judge mediators in mediating the distribution of joint assets at the Tanjung Karang Religious Court, (2) as well as the challenges and factors that influence the success of this process. This research uses applied normative legal methods with a descriptive type, which focuses on the effectiveness of non-judge mediators in mediating the distribution of joint assets at the Tanjung Karang Religious Court. Data was collected through literature study and interviews, with analytical descriptive analysis of primary, secondary and tertiary legal materials. The results of this research analyze the effectiveness of non-judge mediators in mediating the distribution of joint assets at the Tanjung Karang Religious Court. Although the number of cases has decreased, the success rate of mediation has also decreased sharply, with only 1.54% of cases successfully resolved in 2024. Inhibiting factors include obstacles to evidence, communication, and emotional problems of the disputing parties, while supporting factors include institutional support, openness of the parties concerned, and the mediator's expertise. To increase the effectiveness of mediation, it is necessary to disseminate the benefits of mediation to increase community participation and strengthen training for non- judge mediators, especially in mediation techniques, communication and handling the psychological aspects of disputes, with the support of experts such as psychologists.
