Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Salah satu perbuatan hukum peralihan hak atas tanah ialah dengan jual beli tanah. Jual beli merupakan suatu perjanjian dengan mana pihak yang satu mengikat dirinya untuk menyerahkan suatu kebendaan dan pihak lain untuk membayarkan harga yang telah diperjanjikan, sebagaimana diatur dalam Pasal 1457 KUHPerdata. Transaksi jual beli sering berujung sengketa di Pengadilan. Seperti hal nya sengketa jual beli hak atas tanah yang sertifikat kepemilikannya belum dibalik namakan yang menjadi objek dalam penelitian ini. Jenis penelitian ini bersifat deskriptif, dengan pendekatan yuridis normatif. Data yang digunakan adalah data sekunder sebagai data pendukung yang dikumpulkan melalui studi kepustakaan dan studi dokumen dengan pengolahan data melalui pengumpulan, klasifikasi dan sistemasi data. Setelah data terkumpul kemudian di analisis secara kualitatif untuk memperoleh suatu kesimpulan. Berdasarkan hasil penelitian dan pembahasan bahwa penyelesaian sengketa jual beli tanah hak atas tanah yang sertifikat kepemilikannya belum dibalik namakan dilakukan melalui sidang pengadilan. Penggugat mengajukan gugatan terhadap tergugat (penjual) dan turut tergugat (Kantor ATR/BPN Kalianda) atas tanah yang sudah dibelinya, namun belum sempat dibalik namakan karena pihak tergugat tidak diketahui keberadaannya. Majelis hakim mengabulkan gugatan penggugat secara keseluruhan, menyatakan bahwa surat jual beli tanah dan kepemilikan tanah seluas 3.445 m² adalah sah dan berkekuatan hukum. Hakim juga memberikan hak kepada penggugat untuk melakukan peralihan hak sertifikat tanah, serta menghukum tergugat untuk tunduk pada putusan ini. Buying and selling is an agreement by which one party binds himself to hand over an object and the other party to pay the agreed price, as regulated in Article 1457 of the Civil Code. Buying and selling transactions often end in disputes in court. Such as the dispute over the sale and purchase of land rights whose certificate of ownership has not been changed to another name, which is the object of this study. Thia type of research is descriptive, with a normative legal approach. The data used is secondary data as supporting data collected through data collection, classification and systematization. After the data is collected, is is then analyzed qualitatively to obtain a conclusion. Based on the results of the research and discussion, the settlement of land sale and purchase disputes over land rights whose ownership certificates have not been transferred to another name is carried out through a court hearing. The plaintiff filed a lawsuit against the defendant (seller) and co-defendant (ATR/BPN Kalianda Office) for land that had been purchased, but had not been transferred to another name because the defendant’s whereabouts were unknown. The panel of judges granted the plaintiff’s lawsuit in its entirety, stating that the land sale and purchase agreement and ownership of 3,445m² of land were valid and legally binding. The judge also gave the plaintiff the right to transfer the land certificate rights, and sentenced the defendant to submit to this decision.
