Meningkatnya tuntutan pelayanan kesehatan mendorong rumah sakit untuk meningkatkan kualitas layanan, termasuk melalui sistem informasi digital seperti informed consent electronic yang merupakan persetujuan pasien atas tindakan medis yang dijelaskan oleh dokter. Periksa.id sebagai penyedia sistem informasi kesehatan berbasis cloud menawarkan solusi digitalisasi rekam medis dan informed consent electronic untuk meningkatkan mutu pelayanan rumah sakit, termasuk di RSUD Zainal Abidin Pagar Alam Way Kanan. Penelitian ini berfokus pada analisis yuridis pelaksanaan informed consent electronic di RSUD Zainal Abidin Pagaralam. Tujuan dari penelitian ini adalah untuk menganalisis pelaksanaan informed consent electronic di RSUD Zainal Abidin Pagaralam Way Kanan sesuai dengan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan, menganalisis hambatan yang terjadi dan mengetahui akibat hukum dari pelaksanaan informed consent electronic. Jenis penelitian yang digunakan adalah normative terapan. Sumber data menggunakan data primer dan data sekunder dengan bahan hukum primer, dan sekunder. Metode pengumpulan data melalui studi Pustaka dan wawancara dengan metode pengolahan data terdiri dari pemeriksaan, verifikasi, klasifikasi dan sistematisasi data. Analisis data bersifat kualitatif. Hasil penelitian menunjukan bahwa yang pertama, pelaksanaan informed consent electronic di RSUD Zainal Abidin Pagar Alam sudah sesuai dengan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Kedua, dalam pelaksanaan informed consent electronic terdapat hambatan baik dokter seperti kurangnya interaksi antara dokter dan pasien, infrastruktur teknologi informasi yang kurang memadai, sedangkan hambatan pada pasien seperti kendala budaya dan etika, kesenjangan akses teknologi, kurangnya pemahaman dan literasi digital pada pasien lanjut usia. Ketiga, pelaksanaan informed consent electronic menimbulkan hak dan kewajiban dengan jaminan kepastian hukum bagi kedua belah pihak. Saran ditujukan kepada Pemerintah untuk meningkatkan infrastruktur teknologi agar implementasi informed consent electronic menjadi aktual dan aman. Periksa.id, a cloud-based health information system provider, offers solutions for digitizing medical records and electronic informed consent to enhance the quality of hospital services, including at RSUD Zainal Abidin Pagar Alam Way Kanan. This research focuses on a juridical analysis of the implementation of electronic informed consent at RSUD Zainal Abidin Pagaralam. The objectives of this research are to analyze the implementation of electronic informed consent at RSUD Zainal Abidin Pagaralam Way Kanan in accordance with Law Number 17 of 2023 concerning Health, to analyze the obstacles that occur, and to determine the legal consequences of implementing electronic informed consent. The type of research used is normative-empirical. The data sources include primary and secondary data, with primary and secondary legal materials. The data collection methods involve interviews and literature studies, with data processing methods consisting of examination, verification, classification, and systematization of data. The data analysis is qualitative in nature. The results of the study show that first, the implementation of electronic informed consent at RSUD Zainal Abidin Pagaralam is in accordance with Law Number 17 of 2023 concerning Health. Second, in the implementation of electronic informed consent, there are obstacles, both for doctors, such as lack of interaction between doctors and patients, inadequate information technology infrastructure. Meanwhile, obstacles for patients include cultural and ethical barriers, disparities in access to technology, lack of understanding and digital literacy in elderly patients. Third, the implementation of electronic informed consent creates rights and obligations with legal certainty guarantees for both parties. We recommended that the government improve its technological infrastructure to facilitate the effective and secure implementation of electronic informed consent.
