Suatu ikatan perkawinan pastinya akan mengahasilkan harta kekayaan dalam perkawinan. Harta perkawinan terdiri dari harta bawaan, harta bersama, dan harta masing-masing pihak yang diperoleh selama perkawinan. Harta perkawinan menjadi harta waris yang diberikan kepada ahli waris. Permasalahan dalam penelitian ini adalah kedudukan harta bawaan sebagai harta waris dan pelaksanaan pembagian harta bawaan pewaris menurut Kompilasi Hukum Islam. Metode Penelitian dalam penyusunan skripsi ini menggunakan jenis penelitian normatif dan tipe penelitian deskriptif. Pendekatan masalah yang digunakan adalah pendekatan perundang-undangan. Adapun data yang digunakan adalah data sekunder dan sumber hukum yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Metode pengumpulan data dilakukan dengan cara studi kepustakaan, data tersebut akan diverifikasi, klasifikasi, dan sistematisasi data oleh penulis. Analisis data dilakukan secara kualitatif atas data- data yang diperoleh dari hasil pengolahan data. Hasil penelitian dan pembahasan ini diketahui bahwa Harta Bawaan sepanjang tidak ditentukan dalam suatu perjanjian perkawinan berada dibawah penguasaan masing-masing suami istri. Maka kedudukannya menjadi hak dan tanggung jawab masing-masing suami atau istri. Menurut Hukum Waris Islam dalam Kompilasi Hukum Islam Pasal 87 Ayat (1) proses pewarisan harta bawaan pewaris menurut hukum waris islam dilakukan berdasarkan bagian masing-masing ahli waris yang telah ditetapkan. Kata Kunci: Ahli Waris, Pembagian Warisan, Harta Bawaan, Kompilasi Hukum Islam A marital bond inevitably results in the accumulation of wealth during the marriage. Marital property consists of pre-marital property, joint property, and individual property acquired during the marriage. Marital property becomes inheritance that is given to the heirs. The issue in this study is the status of pre- marital property as inheritance and the implementation of the distribution of the deceased’s pre-marital property according to the Compilation of Islamic Law. The research method used in this thesis is normative research with a descriptive research type. The legal approach applied is a statutory approach. The data used is secondary data, and the legal sources consist of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection is conducted through library research, and the data will be verified, classified, and systematized by the author. Data analysis is carried out qualitatively on the data obtained from the processing of information. The results of this study indicate that, , it is understood that separate property (Harta Bawaan), as long as it is not stipulated otherwise in a prenuptial agreement, remains under the control of each spouse individually. Therefore, it becomes the right and responsibility of each husband or wife respectively. According to Islamic inheritance law in the Compilation of Islamic Law Article 87 (1), the inheritance process of the deceased’s pre-marital property is carried out based on the share of each heir that has been determined.
