Tindak pidana penganiayaan oleh anak merupakan permasalahan yang memerlukan perhatian khusus dalam menentukan sanksi yang akan ditanggung oleh pelaku anak mengingat bahwa awnak merupakan anugerah Tuhan Yang Maha Esa yang harus dijaga harkat dan martabatnya.. Dari hasil perolehan data 3 (tiga) tahun terakhir pada Polresta Bandar Lampung terdapat 9 (sembilan) kasus yang melibatkan anak sebagai pelaku tindak pidana penganiayaan dan hanya 3 (tiga) yang dapat terselesaikan melalui diversi. Penelitian ini bertujuan untuk menganalisis serta membahas implementasi diversi dalam penanggulangan tindak pidana penganiayaan yang dilakukan oleh anak serta mengetahui hambatan yang ada pada proses diversi di Polres Bandar Lampung. Metode yang digunakan dalam penelitian ini adalah Yuridis Normatif dan Yuridis Empiris. Adapun sumber dan jenis data yang digunakan adalah data primer yang diperoleh dari studi lapangan dengan melakukan wawancara dan data sekunder yang diperoleh dari studi kepustakaan. Narasumber penelitian ini adalah Kasubnit 1 Unit PPA dan Dosen Bagian Hukum Pidana Fakultas Hukum Universitas Lampung. Data yang telah diperoleh tersebut dianalisis secara kualitatif. Hasil penelitian dan pembahasan ini adalah: (1) Implementasi diversi terhadap tindak pidana penganiayaan yang dilakukan oleh anak di Polres Bandar Lampung merupakan upaya diversi yang dilakukan pada tahap penyidikan. Implementasi diversi pada Polres Bandar Lampung sudah sesuai dengan ketentuan yang termuat dalam Pasal 7 ayat (1) Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak bahwa pada tingkat penyidikan, penuntutan, dan pemeriksaan perkara Anak wajib diupayakan diversi, namun belum berjalan secara maksimal. Hal ini dapat dilihat dari banyaknya jumlah kasus yang tidak terselesaikan secara diversi. (2) Faktor penghambat implementasi diversi sebagai penyelesaian kasus tindak pidana Adimas Maharaja Syahadat penganiayaan yang dilakukan oleh anak di Polres Bandar Lampung yaitu: kurangnya kepercayaan masyarakat terhadap aturan diversi, kurangnya personil Bapas, sulit mempertemukan para pihak yang terkait, dan beberapa faktor internal maupun faktor eksternal. Saran dalam penelitian ini adalah (1) Kepolisian dapat meningkatkan sosialisasi tentang diversi melalui anggotanya dengan adanya penyuluhan di lingkungan serta sekolah-sekolah agar para orang tua serta anak dibawah umur mendapat pemahaman tentang diversi. (2) Pihak kepolisian perlu memperhatikan faktor- faktor yang menjadi hambatan yang bersifat internal maupun eksternal dalam pelaksanaannya agar diversi dapat tercapai. Kata Kunci: Implementasi Diversi, Penganiayaan, Penyidikan. The criminal act of assault by children is an issue that requires special attention in determining sanctions for child perpetrators, considering that children are a gift from God Almighty and must be protected in terms of their dignity and worth. Based on data obtained from the Bandar Lampung Police Department over the past three years, there were nine (9) cases involving children as perpetrators of criminal acts of assault, of which only three (3) were resolved through diversion. This study aims to analyze and discuss the implementation of diversion in addressing criminal acts of assault committed by children and to identify obstacles encountered in the diversion process within the Bandar Lampung Police Department. The methods employed in this research are Normative Juridical and Empirical Juridical approaches. The sources and types of data used include primary data obtained through field studies by conducting interviews, and secondary data gathered from literature studies. The research informants consist of the Deputy Chief of Unit 1 of the Women and Children Protection Unit (PPA) and a Criminal Law Lecturer from the Faculty of Law, University of Lampung. The data obtained are analyzed qualitatively. The findings and discussion of this research are as follows: (1) The implementation of diversion for criminal acts of assault committed by children at the Bandar Lampung Police Department represents efforts conducted during the investigation phase. The implementation of diversion at the Bandar Lampung Police Department aligns with the provisions outlined in Article 7 paragraph (1) of Law No. 11 of 2012 on the Juvenile Criminal Justice System, which mandates the pursuit of diversion at the levels of investigation, prosecution, and trial. However, the implementation has not been fully effective, as evidenced by the large number of cases that remain unresolved through diversion. (2) The inhibiting factors in the implementation of diversion as a means of resolving criminal acts of assault committed by children at the Bandar Lampung Police Department include: lack of public trust in diversion regulations, insufficient Adimas Maharaja Syahadat personnel at the Correctional Institution (Bapas), difficulties in bringing the concerned parties together, as well as several internal and external factors The recommendations of this study are: (1) The police should enhance the dissemination of information about diversion through their members by conducting community and school outreach programs, so that parents and minors gain a better understanding of diversion. (2) The police should address the internal and external factors that hinder the implementation of diversion to ensure its successful application.
