Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

ABSTRAK Perlindungan terhadap hak cipta software di indonesia masih sangatlah rendah, pelanggaran hukum yang terjadi meski sudah di atur dalam Undang-Undang No 28 Tahun 2014 Tentang Hak Cipta, namun dari segi implementasinya masih sangatlah rendah,dari berbagai aspek, sejak Indonesia menandatangani TRIPs agreement Indonesia juga menganut doktrin fair use, namun penganutan doktrin ini juga menjadi problematika di dunia pendidikan, lantas bagaiman penerapan dan batasan wajar dalam penerapan doktrin fair use di Indonesia Pada penelitian ini penulis menggunakan pendekatan normatif terhadap studi hukum. Penelitian hukum adalah penelitian dengan pendekatan doktrinal yang bersifat normatif, atau penelitian hukum yuridis normatif atau penelitian hukum normatif pada dasarnya merupakan suatu kegiatan yang akan mengkaji aspek-aspek (untuk menyelesaikan masalah-masalah yang ada di dalam) internal dari hukum positif. Perlindungan hukum terhadap Software di Indonesia dapat di lakukan dengan dua cara yaitu secara preventif dan secara represif, sedangkan penerpan doktrin fair use dalam pengembangan software di Indonesia masih menghadapi tantangan yang signifikan, baik dari sisi regulasi maupun penegakan hukum. Ketiadaan pengaturan yang spesifik dalam Undang-Undang Hak Cipta menyebabkan ketidakpastian hukum yang dapat menghambat inovasi di sektor teknologi. Hasil kajian menunjukkan perlunya pengembangan kerangka evaluasi yang lebih rinci untuk memastikan keseimbangan antara perlindungan hak cipta. Selain itu, edukasi dan sosialisasi terkait konsep fair use menjadi Langkah strategis untuk meningkatkan pemahaman masyarakat dan pelaku pendidik. Dengan kebijakan yang mendukung inovasi, Indonesia dapat memperkuat daya saing global sekaligus mendorong pembangunan ekonomi berkelanjutan. In this research the author uses a normative approach to legal studies. Legal research is research with a doctrinal approach that is normative in nature, or normative juridical legal research or normative legal research is basically an activity that will examine aspects (to solve problems that exist within) internal of positive law. Legal protection of software in Indonesia can be done in two ways, namely preventively and repressively, while the application of the fair use doctrine in software development in Indonesia still faces significant challenges, both in terms of regulation and law enforcement. The absence of specific arrangements in the Copyright Law causes legal uncertainty that can hamper innovation in the technology sector. The study results indicate the need to develop a more detailed evaluation framework to ensure a balance between copyright protection. In addition, education and socialization related to the concept of fair use is a strategic step to increase public understanding and educators. With policies that support innovation, Indonesia can strengthen its global competitiveness while promoting sustainable economic development. Keywords: Fair Use, Copyright, Education
