Abstract

Penelitian ini membahas peran dan kewenangan Badan Pengawas Pemilihan Umum (Bawaslu) Provinsi Lampung dalam upaya mencegah tindak pidana Pemilu, khususnya pada Pemilu 2024, melalui strategi yang diterapkan serta hambatan yang dihadapi dalam menjalankan fungsi pencegahan. Penelitian ini menerapkan metode kualitatif dengan pendekatan deskriptif untuk memperoleh pemahaman yang mendalam mengenai peran dan kewenangan Bawaslu Provinsi Lampung dalam upaya pencegahan tindak pidana Pemilu serta hambatan yang dihadapi. Temuan penelitian ini menunjukkan bahwa Bawaslu menjalankan sejumlah strategi dalam melaksanakan fungsi pencegahan. Peran tersebut diwujudkan melalui identifikasi dan pemetaan kerawanan melalui Indeks Kerawanan Pemilu (IKP); koordinasi dengan Pemerintah Daerah, KPU, kepolisian, dan kejaksaan melalui Sentra Gakkumdu; serta edukasi kepada masyarakat dan peserta Pemilu. Bawaslu juga memanfaatkan inovasi digital seperti SIGAP Lapor (Sistem Informasi Penanganan Pelanggaran), SIWASLU (Sistem Pengawasan Pemilu), dan SIPS (Sistem Penyelesaian Sengketa), serta formulir A pengawasan online. Selain itu, Bawaslu mendorong pengawasan partisipatif melalui pembentukan kader pengawasan partisipatif. Dari aspek kewenangan, Bawaslu memiliki kewenangan dalam bentuk penerbitan surat imbauan dan teguran; kewenangan pencegahan melalui patroli pengawasan dan sosialisasi; serta kewenangan penindakan melalui tindak lanjut laporan atau temuan yang dilakukan melalui koordinasi dengan Sentra Gakkumdu. Hambatan yang dihadapi meliputi hambatan normatif berupa keterbatasan kewenangan, multitafsir regulasi, dan rendahnya kesadaran hukum masyarakat; sedangkan hambatan teknis mencakup keterbatasan sumber daya manusia, anggaran, akurasi data pemilih, serta kendala koordinasi dalam Sentra Gakkumdu. This study discusses the role and authority of the Lampung Provincial Election Supervisory Agency (Bawaslu) in preventing election crimes, particularly in the 2024 elections, through the strategies implemented and the obstacles faced in carrying out its preventive functions. This study applies a qualitative method with a descriptive approach to gain an in-depth understanding of the role and authority of Bawaslu Lampung Province in preventing election crimes and the obstacles encountered. The findings of this study show that Bawaslu implements a number of strategies in carrying out its preventive functions. These roles are realized through the identification and mapping of vulnerabilities using the Election Vulnerability Index (IKP); coordination with local governments, the KPU, the police, and the attorney general's office through the Gakkumdu Center; and education for the public and election participants. Bawaslu also utilizes digital innovations such as SIGAP Lapor (Violation Handling Information System), SIWASLU (Election Monitoring System), and SIPS (Dispute Resolution System), as well as online monitoring form A. In addition, Bawaslu encourages participatory monitoring through the formation of participatory monitoring cadres. In terms of authority, Bawaslu has the authority to issue letters of appeal and warnings; the authority to prevent violations through monitoring patrols and socialization; and the authority to take action by following up on reports or findings in coordination with the Gakkumdu Center. The obstacles faced include normative obstacles in the form of limited authority, multiple interpretations of regulations, and low public awareness of the law; while technical obstacles include limited human resources, budget, accuracy of voter data, and coordination constraints within the Gakkumdu Center.
