Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)

Berdasarkan PERMA No. 15 Tahun 2020 Kebijakaan dari Peraturan Kejaksaan tentang adanya restorative justice.saat ini bahwa dalam peraturan tersebut mengenai peran kepala desa. Penelitian ini membahas penyelesaian konflik tindak pidana ringan dengan penerapan Restorative Justice dan menganalisa faktor penghambat peran kepala desa Hajimena dalam penyelesaian konflik tindak pidana ringan dengan Penerapan Restorative Justice. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan normatif yuridis dan empiris. Data yang digunakan dalam penelitian ini adalah data primer dan data sekunder dengan proses pengumpulan data yang dilakukan melalui studi kepustakaan dan studi lapangan. Hasil penelitian menunjukan bahwa Implementasi Peran Kepala Desa Hajimena dalam Penyelesaian Konflik Tindak Pidana Ringan dengan Penerapan Restorative Justice Kepala desa memiliki peran yang sangat begitu penting serta di butuhkan untuk berperan sebagai penengah dan penyelesain perselishan didalam kehidupan masyarakat Peran kepala desa selalu dipandu oleh diskusi untuk mencapai konsensus bahwa hasilnya mengikat pihak yang berkonflik tidak seharusnya pihak yang dirugikan.. Faktor-faktor yang menghambat Implementasi Peran Kepala Desa Hajimena dalam Penyelesaian Konflik Tindak Pidana Ringan dengan Penerapan Restorative Justice yaitu Faktor Belum adanya Undang-ndang tentang mediasi,adanya perbedaan di kalangan aparat penegak hukum tentang konsep restoratif justice melalui mediasi penal, Saran dari penulisan ini merupakan mekanisme penerapan keadilan restoratif tentunya harus memperhatikan rasa keadilan dalam masyarakat juga memperhatikan efek jera, karena tidak semua kejahatan harus diterapkan penyelesaian perkara dengan memperhatikan keadilan restoratif. Factors that hinder the Implementation of the Role of the Hajimena Village Head in Resolving Minor Criminal Conflicts with the Application of Restorative Justice are Factors The absence of laws on mediation, differences among law enforcement officials about the concept of restorative justice through penal mediation, The suggestion of this writing is that the mechanism for implementing restorative justice must of course pay attention to the sense of justice in society and also pay attention to the deterrent effect, because not all crimes must be applied to case settlement by paying attention to restorative justice.
