Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Korea Selatan merupakan sebuah negara yang sangat maju di berbagai bidang. Akan tetapi, tingginya angka kekerasan seksual di Korea Selatan menjadi salah satu isu pelanggaran hak asasi perempuan yang disoroti oleh dunia. Salah satu penyebab tingginya angka kekerasan seksual tersebut yakni akibat diskriminasi gender, baik secara fisik atau pun non fisik kepada korban mulai dari anak-anak, remaja, hingga dewasa. Penelitian ini bertujuan untuk melihat kepatuhan Korea Selatan pada konvensi internasional CEDAW untuk mengatasi tingginya angka kekerasan seksual dan pelanggaran HAM. Penelitian ini menggunakan teori kepatuhan yang dikemukakan oleh Abbot dan Keohane, serta konsep HAM yang dikemukakan oleh John Locke, dan konsep konvensi internasional berdasarkan pada Konvensi Wina. Penelitian ini dianalisis menggunakan metode kualitatif-deskriptif berdasarkan pada sumber resmi seperti laporan rutin tahunan, berita, artikel, buku, jurnal, atau laman resmi. Penelitian ini berfokus pada kebijakan-kebijakan Korea Selatan dalam mengatasi permasalahan kekerasan seksual yang berkaitan dengan kepatuhannya pada Konvensi CEDAW. Hasil penelitian ini menunjukan bahwa dalam upaya mematuhi Konvensi CEDAW, Korea Selatan belum sepenuhnya mengimplementasikan 3 elemen kepatuhan. Penerapan elemen obligasi dengan membuat kebijakan domestik berdasarkan pasal-pasal Konvensi CEDAW, dan penerapan elemen delegasi dengan menegakan lembaga dalam mengatasi pelanggaran hak asasi perempuan oleh Korea Selatan, dianggap belum patuh oleh Komite CEDAW. Korea Selatan juga belum memenuhi elemen presisi dalam menerapkan kebijakan kepada masyarakat akibat latar belakang budaya dan stereotip masyarakat yang patriarki. Kata Kunci: Kepatuhan, Konvensi CEDAW, Korea Selatan. South Korea is a very advanced country in various fields. However, the high rate of sexual violence in South Korea has become one of the issues of violation of women's human rights raised by the world. One of the causes of the high rate of sexual violence is the result of gender discrimination, both physical and non- physical, against victims ranging from children, teenagers to adults. This research aims to examine South Korea's compliance with the international convention CEDAW to address the high rate of sexual violence and human rights violations. This research uses the theory of compliance put forward by Abbot and Keohane, as well as the concept of human rights put forward by John Locke, and the concept of international conventions based on the Vienna Convention. This research was analyzed using qualitative-descriptive methods based on official sources such as annual routine reports, news, articles, books, journals or official websites. This research focuses on South Korea's policies in overcoming the problem of sexual violence related to its compliance with the CEDAW Convention. The results of this study indicate that in an effort to comply with the CEDAW Convention, South Korea has not fully implemented the 3 elements outlined. The implementation of the obligation element by creating domestic policies based on the articles of the CEDAW Convention, and the implementation of the delegation element by enforcing institutions in addressing women's human rights violations by South Korea, are considered not to have been complied with by the CEDAW Committee. South Korea has also not fulfilled the precision element in implementing policies to the community due to the cultural background and stereotypes of a patriarchal society.
