Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil diterbitkan sebagai landasan yuridis vital untuk menjamin tata kelola birokrasi yang akuntabel dan berintegritas. Di lingkungan Pemerintah Kabupaten Muara Enim, implementasi regulasi ini memiliki urgensi tinggi mengingat adanya tantangan berat berupa penurunan moral aparatur setelah kasus korupsi di tingkat pimpinan daerah. Penelitian ini dilatarbelakangi oleh kesenjangan nyata antara ketatnya aturan negara dengan lemahnya penegakan di lapangan, khususnya adanya indikasi pembiaran sistematis (omission) oleh pejabat berwenang terhadap pelanggaran disiplin sehari-hari yang berpotensi merusak profesionalisme institusi secara menyeluruh. Penelitian ini bertujuan menganalisis implementasi peraturan tersebut serta mengidentifikasi faktor penghambatnya. Penelitian ini menggunakan metode penelitian hukum yuridis normatif dan yuridis empiris. Data dikumpulkan melalui studi kepustakaan terhadap regulasi terkait serta studi lapangan melalui wawancara mendalam dengan otoritas di BKPSDM dan Inspektorat. Analisis data dilakukan secara kualitatif-evaluatif untuk membandingkan norma hukum (das sollen) dengan praktik nyata (das sein). Hasil penelitian menyimpulkan bahwa implementasi peraturan di Kabupaten Muara Enim mengalami kegagalan struktural. Hal ini ditandai dengan absennya sosialisasi formal yang menyebabkan lumpuhnya mekanisme pengawasan lini pertama. Akibatnya, tercipta "fenomena gunung es" di mana hanya pelanggaran berat yang ditindak, sementara akumulasi pelanggaran ringan dan sedang tidak tercatat. Secara yuridis, tindakan pembiaran ini melanggar Asas-Asas Umum Pemerintahan yang Baik (AUPB). Faktor penghambat utama membentuk lingkaran kegagalan yang berakar pada krisis keteladanan pimpinan, kuatnya budaya sungkan, serta kelemahan koordinasi teknis antar-lembaga. Government Regulation Number 94 of 2021 concerning Civil Servant Discipline was issued as a vital juridical foundation to ensure accountable and high-integrity bureaucratic governance. In the environment of the Muara Enim Regency Government, the implementation of this regulation holds high urgency considering the severe challenge of moral degradation among the apparatus following corruption cases at the regional leadership level. This research is motivated by the tangible gap between the strictness of state regulations and the weakness of enforcement in the field, specifically the indication of systematic omission by authorized officials regarding daily disciplinary violations, which potentially undermines institutional professionalism as a whole. This study aims to analyze the implementation of said regulation and identify its inhibiting factors. This research utilizes normative juridical and empirical juridical legal research methods. Data were collected through literature studies on relevant regulations and field studies via in-depth interviews with authorities at the Human Resources Development Agency (BKPSDM) and the Inspectorate. Data analysis was conducted in a qualitative-evaluative manner to compare legal norms (das sollen) with actual practice (das sein). The results of the study conclude that the implementation of the regulation in Muara Enim Regency has experienced structural failure. This is characterized by the absence of formal socialization, which led to the paralysis of the first-line supervision mechanism. Consequently, an "iceberg phenomenon" is created where only serious violations are acted upon, while the accumulation of minor and moderate violations remains unrecorded. Juridically, this act of omission violates the General Principles of Good Governance (AUPB). The main inhibiting factors form a cycle of failure rooted in a crisis of exemplary leadership, a strong culture of reluctance and weak technical coordination between institutions.
