Abstrak (Berisi Bastraknya saja, Judul dan Nama Tidak Boleh di Masukan)
Satwa dilindungi merupakan hewan yang memiliki hak untuk dijaga dan dikembangbiakan agar tetap Lestari. Perkembangan teknologi memberikan celah kepada pemburu melakukan perdagangan gelap melalui kegiatan konvensional maupun media sosial melalui modus operandi pelaku yang telah sistematis berkembang di masyarakat. Berdasarkan latar belakang tersebut penulis merumuskan permasalahan yaitu upaya Subdit IV Tipiter Ditreskrimsus mengungkap perdagangan gelap satwa dilindungi dan faktor penghambat dalam pengungkapan kasus perdagangan gelap satwa dilindungi Penelitian ini menggunakan metode pendekatan yang bersifat yuridis normatif dan didukung yuridis empiris. Narasumber pada penelitian ini terdiri dari Penyidik Pembantu Unit 3 Subdit IV Tipidter Kepolisian Daerah Lampung, Kanit Polhut (Kepala Unit Polisi Kehutanan) BKSDA Bengkulu Seksi Wilayah 3 Lampung, dan Dosen Bagian Hukum Pidana Fakultas Hukum Universitas Lampung. Analisis data secara deskriptif kulitatif. Hasil Penelitian dan pembahasan menunjukkan bahwa upaya penanggulangan Subdit IV Tipidter dalam mengungkap perdagangan gelap satwa dilindungi melalui 2 upaya, yaitu upaya penal dan upaya non penal. Melalui Upaya penal Subdit IV Tipidter Ditreskrimsus menegaskan bahwa kebijakan hukum pidana sebagai pencegahan umum (general prevention) ditegakan sesuai dengan regulasi, mulai dari Tingkat penyidikan hingga putusan pengadilan. Melalui upaya non penal Subdit IV Tipidter Ditreskrimsus Polda Lampung & Balai Konservasi Sumber Daya Alam (BKSDA) bekerjasama dan berkesinambungan melakukan pencegahan non pidana, melalui sosialisasi, edukasi, sharing data, patrol, dan menerima pengaduan dari organisasi Masyarakat. Ada lima faktor penghambat penanggulangan perdagangan gelap satwa dilindungi, salah satunya faktor aparat penegak hukum yang mengalami kekurangan SDM dalam memahami teknik pengungkapan perdagangan gelap satwa. Selain itu, sarana dan prasarana pendukung seperti alat patroli dan pos pengawasan masih belum memadai, menghambat pengawasan di daerah. Adapun saran dalam penelitian ini, diperlukan penguatan kapasitas aparat penegak hukum dan peningkatan sarana prasarana melalui pelatihan teknis serta pemenuhan peralatan patroli dan teknologi pengawasan untuk mendukung penindakan perdagangan gelap satwa dilindungi secara optimal. Selain itu, program edukasi dan sosialisasi intensif kepada masyarakat di Lampung harus dilakukan secara menyeluruh lewat kolaborasi antara Subdit IV Tipidter, BKSDA, organisasi masyarakat sipil, dan media, memanfaatkan teknologi informasi serta media sosial agar kesadaran tentang pentingnya pelestarian satwa Kata Kunci : Upaya Penanggulangan, Perdagangan Gelap, Satwa dilindungi. Protected animals have the right to be protected and bred to ensure their sustainability. Technological developments provide opportunities for poachers to engage in illegal trade through conventional means and social media, using a modus operandi that has systematically developed within society. Based on this background, the author formulates the problem, namely the efforts of Subdit IV Tipidter Ditreskrimsus to uncover the illegal trade in protected animals and the inhibiting factors in uncovering cases of illegal trade in protected animals. This research uses a juridical normative approach supported by empirical juridical methods through applicable legislation, literature studies, and interviews with informants, including Assistant Investigators of Unit 3 Subdit IV Tipidter of the Lampung Regional Police, the Head of Forest Police Unit (Polhut) BKSDA Bengkulu, Lampung Region Section 3, and a Criminal Law Lecturer at the Faculty of Law, University of Lampung. The data is analyzed descriptively qualitatively. The results and discussion show that Subdit IV Tipidter’s efforts to tackle illegal trade of protected wildlife are carried out through two approaches: penal and nonpenal efforts. Through penal efforts, Subdit IV Tipidter Ditreskrimsus enforces general prevention policies in criminal law according to the regulations in Law Number 32 of 2024 on the Conservation of Biological Natural Resources and Their Ecosystems, applicable from the investigation stage to court verdicts. Through nonpenal efforts, Subdit IV Tipidter Ditreskrimsus Lampung Regional Police and BKSDA cooperate continuously in non-criminal prevention by conducting socialization, education, data sharing, patrols, and receiving reports from community organizations. There are five main hindering factors: legislation, law enforcement officers, facilities and infrastructure, society, and culture. In particular, law enforcement officers lack adequate human resources who understand the techniques for uncovering illegal wildlife trade. Additionally, supporting facilities such as patrol equipment and monitoring posts remain inadequate, hindering supervision in several areas. The societal factor is significant due to limited knowledge and education about protected wildlife, especially in Lampung, resulting in low awareness of conservation. These factors are interrelated and become challenges in efforts to eradicate illegal wildlife trade. Based on the findings, this study suggests strengthening the capacity of law enforcement officers and improving facilities and infrastructure through technical training and adequate provision of patrol equipment and surveillance technology to support optimal enforcement against illegal trade of protected wildlife. Furthermore, intensive and comprehensive education and socialization programs for communities in Lampung should be implemented through collaboration between Subdit IV Tipidter, BKSDA, civil society organizations, and media, utilizing information technology and social media to increase awareness of the importance of wildlife conservation and the negative impacts of illegal trade effectively and broadly.
