Abstract

Risk-Based Approach (RBA) business licensing through the Online Single Submission (OSS) system is intended to function as a preventive instrument to mitigate environmental damage caused by tourism activities. However, facts in Tanggamus Regency reveal a serious discrepancy between regulation and implementation, where the majority of tourism destinations operate without possessing environmental documents (AMDAL, UKL-UPL or SPPL) or valid permits, potentially causing ecological degradation as occurred in the Way Bekhak tourism area. This study aims to analyze the implementation of tourism licensing as an instrument of environmental control and to identify obstacles in administrative law enforcement against unlicensed tourism businesses. This research utilizes an empirical juridical method with statutory and sociological approaches. Data was obtained through library research and field studies via interviews with the Investment and One-Stop Integrated Service Agency (DPMPTSP), the Tourism Office, the Environmental Office, and tourism business actors in Tanggamus Regency. Data analysis was conducted using a descriptive qualitative method. The results indicate that tourism licensing as an instrument of environmental control in Tanggamus Regency has not been effective. This is evidenced by the very low compliance of business actors, with only 7.7% (4 out of 52 tourism destinations) possessing complete permits. This ineffectiveness is attributed to obstacles in the legal structure, weak inter-agency coordination, minimal supervision budgets, and legal culture, wherein business actors view permits merely as administrative burdens and lack technological proficiency regarding the OSS system. This study recommends that the Tanggamus Regency Government immediately establish a "Licensing Acceleration Task Force" to provide proactive assistance (jemput bola) in issuing Business Identification Numbers (NIB) and environmental documents at tourism locations, as well as strictly apply administrative sanctions to ensure legal certainty and environmental sustainability.
