Abstract

Kasus Honour Killing yang terus terjadi di Pakistan meskipun negara tersebut telah meratifikasi CEDAW menunjukkan adanya kesenjangan antara komitmen internasional dan pelaksanaannya di tingkat domestik. Kondisi ini menimbulkan pertanyaan mengenai bagaimana Pakistan mengadopsi serta menerapkan prinsip-prinsip CEDAW pasca-amandemen hukum tahun 2016, terutama dalam konteks budaya patriarkal dan tekanan internasional yang semakin meningkat. Penelitian ini menggunakan metode kualitatif deskriptif melalui studi literatur dan analisis dokumentasi. Fokus penelitian diarahkan pada evaluasi reformasi hukum, kebijakan, serta hambatan struktural yang memengaruhi implementasi CEDAW. Analisis dilakukan menggunakan teori Compliance dan Spiral Model of Human Rights Change untuk memahami tahapan kepatuhan Pakistan terhadap norma HAM internasional. Hasil penelitian menunjukkan bahwa Pakistan telah melakukan beberapa langkah reformasi penting, namun implementasinya masih bersifat terbatas dan belum mencapai kepatuhan substantif. Praktik Honour Killing tetap berlangsung akibat lemahnya penegakan hukum, resistensi budaya, serta celah dalam sistem peradilan. Dengan demikian, Pakistan masih berada pada tahap tactical concessions hingga prescriptive status, di mana perubahan normatif telah terjadi tetapi belum sepenuhnya tercermin dalam perilaku institusional. Kata Kunci : CEDAW, Honour Killing, Pakistan, teori kepatuhan, Spiral Model. Despite Pakistan‟s ratification of CEDAW, cases of Honour Killing continue to occur, indicating a gap between international commitments and domestic implementation. This raises the central question of how Pakistan has adopted and applied CEDAW principles following the 2016 legal amendment, particularly within a deeply patriarchal social context and under growing international scrutiny. This study employs a descriptive qualitative method through literature review and document analysis. The research focuses on assessing legal reforms, policy measures, and structural barriers influencing CEDAW implementation. The analysis is guided by Compliance Theory and the Spiral Model of Human Rights Change to examine Pakistan‟s stages of adherence to international human rights norms. The findings show that while Pakistan has undertaken several reform efforts, their implementation remains limited and has not reached substantive compliance. Honour Killing persists due to weak law enforcement, cultural resistance, and gaps within the judicial system. Consequently, Pakistan remains within the stages of tactical concessions to prescriptive status, where normative changes exist but have not yet translated into consistent institutional practice.
