Menara telekomunikasi diatur di dalam UU No 36 Tahun 1999 Tentang Telekomunikasi di Kota Bandar Lampung di atur dalam Peraturan Walikota No 7 tahun 2015 Tentang Pembangunan dan Penataan Menara Telekomunikasi tetapi, dalam penerapan di lapangan masih terdapat menara telekomunikasi yang belum memiliki izin dan sampai saat ini masih ada beberapa yang berdiri. Permasalahannya adalah (1) bagaimanakah penegakan hukum terhadap menara telekomunikasi tak berizin di Bandar lampung (2) faktor-faktor penghambat dalam penegakan hukum menara telekomunikasi tak berizin di Bandar lampung. Penelitian ini dilakukan melalui pendekatan normatif dan empiris dengan data primer dan data sekunder, data diperoleh dari penelitian kepustakaan dan lapangan. Analisis data dilakukan secara kualitatif. Berdasarkan hasil penelitian dan pembahasan bahwa, (1) Penegakan hukum terhadap menara telekomunikasi tak berizin di kota Bandar lampung dilakukan dengan dua cara yaitu: Secara preventif berarti pengawasan aktif dilakukan terhadap kepatuhan, kepada peraturan tanpa kejadian langsung yang menyangkut peristiwa konkrit yang menimbulkan sangkaan bahwa peraturan hukum telah dilanggar. yaitu dilakukan dengan cara penyuluhan, pemantauan dan penggunaan kewenangan yang bersifat pengawasan (pengambilan sampel, penghentian dan sebagainya) Kemudian Secara Reprensif jelas diatur dalam Pasal 26 Peraturan Walikota Nomor 7 Tahun 2015 berupa sanksi adminisratif yaitu peringatan tertulis, penghentian pembangunan kegiatan pembangunan, penghentian sementara operasional menara, pembekuaan sementara IMB menara, pencabutan IMB menara dan perintah pembongkaran menara. (2) Faktor penghambat dalam penegakan hukum terhadap menara telekomunikasi tak berizin di Kota Bandar Lampung antara lain, kurang Optimalnya Tim Pengawasan Pemerintah Kota Bandar lampung, kurangnya Sumber Daya Manusia yang menangani mengenai Pengendalian Menara Telekomunikasi, Penyelenggara Menara Telekomunikasi yang tidak mempunyai itikad baik; dan kurangnya kordinasi antar satuan kerja perangkat daerah. Saran dalam penelitian ini adalah 1) Penerapan perizinan agar memberikan kepastian hukum kepada penanggung jawab terhadap pihak pendiri menara telekomunikasi; dan 2) reformasi birokrasi dalam proses permohonan perizinan dan penambahan sumber daya manusia sebagai pengawas dan pengendali untuk menjamin terlaksananya penegakan hukum dibidang perizinan telekomunikasi di Kota Bandar Lampung. Kata Kunci: Penegakan Hukum, Perizinan, Menara Telekomunikasi LAW ENFORCEMENT AGAINST UNAUTHORIZED TELECOMMUNICATION TOWERS IN BANDAR LAMPUNG Telecommunication Towers is a manifestation of technological development which is becoming a necessity as people cannot be separated from a means of communication to take part in development. Telecommunication tower has been regulated under Law No. 36/1999 and in Bandar Lampung, it has been set under Mayor Regulation No. 7/2015 regarding the Development and Planning of Telecommunication Towers; however, there are still some towers which have not been licensed and they are remain unauthorized. The problems in this research are formulated as follows: (1) how is the law enforcement against unauthorized telecommunication towers in Bandar Lampung (2) what are the inhibiting factors in law enforcement of the unauthorized telecommunication towers in Bandar Lampung. This research was conducted through a normative and empirical approaches using primary data and secondary data which were obtained from literature study and field research. The data were analyzed qualitatively. Based on the results of the research and discussion, it showed that (1) The law enforcement against unauthorized telecommunication towers in the city of Bandar Lampung was done in two measures: By applying preventive measures which means active supervision was conducted on compliance, to rule without an incident necessarily to happen of real setting which raise a suspicion of rules had been violated. This effort was done by means of education, monitoring and use of monitored authority (sampling, termination, etc.) While in represive measure as stipulated in Article 26 of the Mayor Regulation Number 7/ 2015 regarding the administrative sanctions in form of written warnings, discontinuation of construction development, the temporary suspension of operations tower, temporary inactivation of IMB tower, revocation of IMB towers and tower demolition order. (2) The inhibiting factors in law enforcement against the unauthorized telecommunication towers in the city of Bandar Lampung included: the supervisory boards of Bandar Lampung local government was less optimal, the lack of human resources to handle the Control of Telecommunication Tower, mannerless operator, and lack of coordination between local work unit. Risky Khairullah The researcher suggested that 1) It is important to implement the authorization in order to provide legal certainty to the person in charge of the telecom towers; and 2) It is important to reform the bureaucracy during the process of authorization and to increase the number of human resources as supervisor and control power to ensure the law enforcement of the authorization of telecommunication towers in the city of Bandar Lampung.
