Penerapan Kawasan Tanpa Rokok merupakan upaya Pemerintah untuk melindungi dan menjamin hak setiap orang untuk menghirup udara bersih tanpa asap rokok. Salah satu cara Pemerintah dalam mewujudkan tujuan Kawasan Tanpa Rokok adalah melalui penegakan sanksi administratif. Terdapat 3 Badan/Lembaga yang berwenang dalam melakukan pembinaan dan pengawasan Kawasan Tanpa Rokok, akan tetapi Penegakan sanksi administratif bagi pelanggar Kawasan Tanpa Rokok masih terkendala karena kurangnya pembinaan dan pengawasan.

Permasalah dalam penelitian ini adalah bagaimanakah upaya Pemerintah Kota Metro dalam penegakan sanksi administratif Peraturan Daerah Kota Metro Nomor 4 Tahun 2014 Tentang Kawasan Tanpa Rokok dan bagaimanakah mekanisme pengenaan sanksi administratif dalam Peraturan Daerah Kota Metro Nomor 4 Tahun 2014 Tentang Kawasan Tanpa Rokok. Pendekatan masalah yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif.

Hasil penelitian menunjukan bahwa dalam aspek pengaturan, aparat penegak, strategi penegakan, dan mekanisme pengenaan sanksi administratif dalam Peraturan Daerah Kota Metro Nomor 4 Tahun 2014 tentang Kawasan Tanpa Rokok sudah terangkai dengan cukup jelas, namun masih terdapat kesalahan pada beberapa pasal dalam aturannya yang menyebabkan bergesernya makna dari pasal tersebut. Selain itu, penegakan sanksi terhadap pelanggaran Kawasan Tanpa Rokok tidak terlaksana sebagaimana mestinya karena upaya Pemerintah Kota Metro dalam penegakan kawasan tanpa rokok belum maksimal. Permasalahan biaya oprasional yang belum berjalan optimal mengakibatkan seluruh proses baik pembinaan maupun pengawasan Kawasan Rokok tidak terlaksana. Penegakan sanksi administratif Kawasan Tanpa Rokok akan sulit terwujud mengingat belum maksimalnya upaya Pemerintah Kota Metro dalam menjalankan Peraturan Daerah Kota Metro Nomor 4 Tahun 2014 tentang Kawasan Tanpa Rokok.

ABSTRACT


The Implementation of No Smoking Areas is an attempt by the Government to protect the right of everyone to breathe clean air without cigarette smoke. One of the ways the Government in realizing the goal of No Smoking Area is through the enforcement of administrative sanctions. There are 3 institutions authorized in conducting development and supervision of No Smoking Area, but the enforcement of administrative sanctions for offenders of No Smoking Areas is still constrained due to lack of guidance and supervision.

The problem in this research is how is the effort of Metro City Government in enforcing administrative sanction of Regulation Regulation of Metro City Number 4 Year 2014 about No Smoking Area and how is the mechanism of imposition of administrative sanction in Regional Regulation of Metro City Number 4 Year 2014 about No Smoking Area. The problem approach used in this research is the normative juridical approach.

The results show that in the ascpects of regulatory, enforcement officers, enforcement strategies, and the mechanism of imposition of administrative sanctions in the Regional Regulation of Metro City Number 4 Year 2014 about No Smoking Area has been arranged clearly, but there are still errors in some of the articles in the rules that caused the meaning of the chapter changed. In addition, the enforcement of sanctions against No Smoking Area violations was not implemented properly due to the efforts of Metro City Government in the enforcement of No Smoking Area has not been maximized. The problem of operational cost that has not run optimally resulted in the entire process of both the guidance and supervision of the No Smoking Area is not implemented. The enforcement of administrative sanction of No Smoking Area will be difficult to be realized considering the not yet maximal efforts of Metro City Government in implementing Regional Regulation of Metro City Number 4 Year 2014 about No Smoking Area.
