N2  - Jaminan kesehatan dan keselamatan kerja merupakan hak pekerja yang harus dipenuhi oleh perusahaan dengan dasar hukum yaitu Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Kesenjangan yang terjadi di lapangan adalah tenaga kerja kurang memahami hak-hak yang seharusnya mereka terima setelah diikutsertakan oleh perusahaan pada program BPJS Ketenagakerjaan, padahal sebagian besar tenaga kerja PT. Bukit Asam (Persero) merupakan tenaga lapangan sangat rentan mengalami kecelakaan kerja.Permasalahan penelitian ini adalah: (1) Bagaimanakah pemenuhan hak buruh atas jaminan kesehatan dan keselamatan kerja pada PT Bukit Asam Bandar Lampung? (2) Bagaimana hubungan pelaksanaan BPJS dengan status buruh pada PT Bukit Asam Bandar Lampung?

Penelitian ini menggunakan pendekatan yuridis normatif dan empiris. Pengumpulan data dengan studi lapangan dan studi pustaka. Pengolahan data meliputi seleksi, klasifikasi dan penyusunan data. Analisis data dilakukan secara yuridis kualitatif.

Hasil penelitian ini menunjukkan: (1) Pemenuhan hak buruh atas jaminan kesehatan dan keselamatan kerja pada PT Bukit Asam Bandar Lampung dilaksanakan oleh perusahaan dengan cara mendaftarkan para buruh/pekerja melalui BPJS Ketenagakerjaan, sehingga para buruh mendapatkan jaminan atas kesehatan dan keselamatan kerja mereka dari perusahaan yang meliputi program Jaminan Hari Tua (JHT), Jaminan Kecelakaan Kerja (JKK), Jaminan Kematian (JKM) dan Jaminan Pensiun. (2) Hubungan pelaksanaan BPJS Ketenagakerjaan dengan status buruh sebagai pekerja tetap adalah dengan mendaftarkan seluruh pekerja sebagaimana diatur dalam Undang-Undang Ketenagakerjaan. Pelaksanaan BPJS Ketenagakerjaan bagi pekerja tidak tetap dilaksanakan dengan program Bukan Penerima Upah (BPU) dari BPJS. Beberapa fasilitas yang akan didapat para pekerja tidak tetap adalah mendapatkan fasilitas perawatan dan pengobatan, mendapatkan cover penuh, mendapatkan jaminan kematian dan iuran yang murah dan terjangkau.

IMPLEMENTATION OF SOCIAL LABOR INSURANCE BY 
AGENCY OF SOCIAL LABOR INSURANCE ON WORKERS 
OF PT BUKIT ASAM BANDAR LAMPUNG

Health and safety assurance is the right of workers to be fulfilled by the company on a legal basis Law Number 13 Year 2003 on Manpower.The gap that occurs in the field is that workers do not understand the rights they should receive after being included by Social Labor Insurance Agency program, even though most of the workforce of PT. Bukit Asam (Persero) is a field worker very vulnerable to work accidents. The problems of this research are: (1) How is the fulfillment of labor rights on health and safety guarantee at PT Bukit Asam Bandar Lampung? (2) How is the relationship of Social Labor Insurance Agency implementation with the status of workers at PT Bukit Asam Bandar Lampung?

This research uses normative and empirical juridical approach. Data collection by field study and literature study. Data processing includes selection, classification and compilation of data. Data analysis is done by qualitative juridical.

The results of this study indicate: (1) The fulfillment of workers' right to health and safety guarantee at PT Bukit Asam Bandar Lampung implemented by the company by registering the workers / workers through Social Labor Insurance Agency of Employment, so that workers get security for their health and safety from the company which includes the Old Age Guarantee program, Work Accident Insurance  Death Insurance and Pension Guarantee. (2) Relationship of the implementation of Social Labor Insurance Agency of Employment with the status of workers as permanent workers is to register all workers as stipulated in the Manpower Act. Implementation of Social Labor Insurance Agency of Employment for non-permanent workers is carried out with the Non-Beneficial Wages program of Social Labor Insurance Agency. Some of the facilities to be gained by non-permanent workers are getting care and treatment facilities, getting full cover, getting death insurance and cheap and affordable fee.
