N2  - Tujuan penelitian ini adalah menyadarkan pemerintah pusat dan pemerintah daerah
agar lebih memperhatikan nasib TKW dan anak TKW yang ditinggalkan
orangtuanya bekerja keluar negeri sehingga tidak ada masalah-masalah yang terjadi
seperti sebelumnya. Metode yang digunakan dalam penelitian ini adalah metode
deskriptif kualitatif dengan subyek penelitian TKW yang sudah pulang, keluarga
TKW, dan anak dari TKW. Teknik pengumpulan data menggunakan wawancara,
observasi, dan dokumentasi sedangkan analisis data menggunakan uji kredibilitas
dengan kritik sumber dan triangulasi data.
Hasil penelitian ini menunjukkan bahwa terjadinya kekosongan hukum di dalam
undang-undang no. 39 tahun 2004 tentang penempatan dan perlindungan tenaga kerja
Indonesia di luar negeri terhadap undang-undang no.35 tahun 2014 tentang
perlindungan anak sehingga menyebabkan hak-hak anak TKW yang ditinggalkan
orangtuanya bekerja tidak terpenuhi seutuhnya baik dari pemerintah, pemerintah
daerah, orangtua dan masyarakat.

This study aimed to aware of the central dan local government to be more concern
about the fate of Indonesian female migrant workers dan their children, so there is no
problem as it happened before. The researcher used a qualitative-descriptive research
method. The data collection techniques used by the researcher are an interview,
observation, and documentation among Indonesian female migrant workers who
already home, their children and family. A test of credibility with source criticism and
data triangulation is the data analysis used by the researcher.
The result of the study showed that there are gaps in the law in the law of the
Republic of Indonesia number 39 the year 2004 about the placement and protection of
the Indonesian migrant workers towards the law of the Republic of Indonesia number
35 the year 2014 about the child protection. This gap of the law caused the child?s
rights incompletely fulfilled from the central dan local government, the parents and
the society.
