Namun pada kasus di atas hingga\r\nputusnya putusan pengadilan, jasad Caswita tidak pernah ditemukan.\r\nPermasalahan penelitian ini adalah bagaimanakah proses pembuktian perkara\r\npembunuhan tanpa jasad korban oleh jaksa penuntut umum dan apakah faktor\r\npenghambat penegakan hukum perkara pembunuhan tanpa jasad korban oleh\r\njaksa penuntut umum.\r\nPenelitian ini menggunakan pendekatan yuridis normatif dan yuridis empiris.\r\nProsedur pengumpulan data dilakukan dengan studi pustaka dan studi lapangan,\r\ndata dianalisis secara kualitatif guna memperoleh simpulan dan saran.\r\nHasil penelitian dan pembahasan menunjukkan bahwa pembuktian merupakan\r\npoin utama dalam pemeriksaan perkara di pengadilan. Jaksa dalam mengadili\r\nseseorang yang terbukti melakukan tindak pidana akan memperhitungkan semua\r\ntindak pidana yang dilakukannya sehingga baik yang dirugikan maupun\r\nmasyarakat merasa dakwaannya adil karena penuntut umum harus selalu\r\nbertindak berdasarkan hukum. Pembuktian pasal pembunuhan berencana\r\ndilakukan berdasarkan pengakuan terdakwa dan dikaitkan dengan peraturan\r\nperundang-undangan yang berlaku serta pendapat saksi ahli sehingga dapat\r\nditetapkan bahwa hal tersebut dapat dikatakan sebagai pembunuhan berencana.\r\nNamun, terdapat hambatan dalam pembuktian perkara ini yaitu jenazah korban\r\ntidak dapat ditemukan sehingga cukup menghambat untuk membuktikan perkara\r\nini.\r\nPada penulisan ini di sarankan untuk Jaksa Penuntut Umum dalam menangani\r\nkasus pembunuhan lebih dalam dan mengulik lebih dalam pada saat pembuktian\r\nsaat menangani kasus pembunuhan sehingga dapat meyakinkan penerapan pasal\r\npembunuhan berencana atau pembunuhan biasa dan disarankan untuk terus\r\nmengulik lebih dalam setiap hambatan yang terjadi seperti penunjukan saksi ahli\r\nyang lebih banyak sehingga dapat menyimpulkam tuntutam yang komprehensif\r\nterhadap perkara pembunuhan tanpa jasad korban.\r\nKata Kunci: Pembuktian, Pembunuhan, Penuntut Umum\r\n\r\nIn general, a murder case can be said to be a homicide if there are bodies of\r\nvictims who have lost their lives and perpetrators who cannot be found or are\r\nfugitives. However, in the case above, until the court's verdict was decided,\r\nCaswita's body was never found. The problem of this research is how is the\r\nprocess of proving the case of murder without the body of the victim by the public\r\nprosecutor and what are the inhibiting factors for law enforcement of the case of\r\nmurder without the body of the victim by the public prosecutor.\r\nThis research uses normative juridical and empirical juridical approaches. Data\r\ncollection procedures were carried out by means of literature and field studies,\r\nthe data were analyzed qualitatively in order to obtain conclusions and\r\nsuggestions.\r\nThe results of the research and discussion show that evidence is the main point in\r\nexamining cases in court. The prosecutor in trying someone who is proven to have\r\ncommitted a crime will take into account all the crimes he has committed so that\r\nboth those who are harmed and the community feel that their indictment is fair\r\nbecause the public prosecutor must always act according to the law. Proof of the\r\npremeditated murder article is carried out based on the defendant's confession\r\nand is linked to the applicable laws and regulations as well as the opinion of\r\nexpert witnesses so that it can be determined that this can be said to be\r\npremeditated murder. However, there are obstacles in proving this case, namely\r\nthe victim's body cannot be found, which is quite an obstacle to proving this case.\r\nAt this writing it is recommended for the Public Prosecutor to handle murder\r\ncases more deeply and dig deeper at the time of proof when handling murder\r\ncases so that they can ensure the application of the article on premeditated\r\nmurder or ordinary murder and are advised to continue to dig deeper into any\r\nobstacles that occur such as the appointment of witnesses more experts so as to be\r\nable to conclude a comprehensive lawsuit against the murder case without the\r\nvictim's body.\r\nKeywords: Proof, Murder, Public Prosecutor"^^<http://www.w3.org/2001/XMLSchema#string> .
